§ 109.05 WITHDRAWAL OF CANDIDACY.
   (A)   Any candidate for municipal office who wishes to withdraw their candidacy and to have his or her name removed from the municipal primary election ballot must file a written statement of such withdrawal from candidacy in the City Clerk's office by on or before 12:00 noon of the first Friday immediately following the close of the candidate filing period. Such written statement of withdrawal from candidacy must be signed by the candidate, dated, and duly notarized. Upon the timely receipt of any candidate's written notice of withdrawal as aforesaid, the City Clerk shall remove that candidate's name from the municipal primary election ballot list. The names of all candidates who have filed for municipal office and who have not withdrawn their names by the aforesaid deadline shall appear on the municipal primary election ballot. Upon the expiration of the aforesaid deadline to withdraw, the City Clerk shall proceed with the preparation of the municipal primary election ballot for certification and printing.
   (B)   Any candidate for municipal office who wishes to withdraw their candidacy and to have his or her name removed from the municipal general election ballot must file a written statement of such withdrawal from candidacy in the City Clerk's Office by on or before 12:00 noon of the first Friday immediately following the certification of the election results from the municipal primary election; provided, however, that, in the event that a recount is requested by any candidate and such recount is conducted, the last day to file such written statement of withdrawal from candidacy in regard to the municipal general election shall be by on or before 12:00 noon of the first Friday immediately following the final certification of the municipal primary election results after such recount. Such written statement of withdrawal from candidacy must be signed by the candidate, dated, and duly notarized. Upon the timely receipt of any candidate's written notice of withdrawal as aforesaid, the City Clerk shall remove that candidate's name from the municipal general election ballot list. The names of all candidates who have won their respective municipal primary election nomination for office and who have not withdrawn their names by the aforesaid deadline shall appear on the municipal general election ballot. Upon the expiration of the aforesaid deadline to withdraw, the City Clerk shall proceed with the preparation of the municipal general election ballot for certification and printing.
