(A) The following schedule of rates, fees and charges are hereby fixed and determined as the rates, fees and charges to be charged to customers of the water system of the city throughout the entire territory served and such rates, fees and charges shall be adopted and placed into effect in lieu of the city’s Water Tariff No. 12 currently on file with the Public Service Commission of West Virginia:
(A) Step 1 rates (to become effective on and after August 31, 2022).
(1) Schedule 1.
(a) Applicability. Applicable within the entire territory served, inside and outside of the corporate limits of the City of Weirton.
(b) Availability. Available for residential, commercial, industrial and resale water service.
(c) Commodity rates. (Customers with metered water supply.) All consumption monthly, $7.75 per 1,000 gallons.
(d) Customer charge. A customer charge of $9.25 per month for all metered connections to the system.
(e) Minimum bill. Each customer shall pay a minimum charge of $17 monthly (equivalent to 1,000 gallons of water usage + $9.25 customer charge).

(f) Flat-rate monthly charge. Forty-four dollars and thirteen cents. (Customers with non-metered water supply - equivalent to 4,500 gallons of water usage + $9.25 customer charge.)
(g) Delayed payment penalty. The above schedule is net. On all current usage billings not paid in full when due, 5% will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be collected once for each bill where it is appropriate.
(h) Water service connection charge. The charge for an approved service connection to the water system will be $750, or the actual cost of the connection (solely determined by the Water Board) whichever is greater, for all new taps to the system.
(i) Returned check charge. A service charge of $25 will be imposed upon any customer whose check for payment of charges is returned by the bank for any reason.
(j) Disconnect charge/reconnection charge/administrative fee.
1. Water service will not be restored until all past due water bills have been paid in full and all accrued penalties, plus a disconnection charge of $25, have been paid.
2. There shall be a $25 reconnection charge paid prior to restoration of water service which has been previously disconnected for any reason.
3. In the event that city staff or agents collect money at the customer's residence or otherwise give the customer the opportunity to pay the bill at the office in order to stop disconnection, an administrative fee of $25 shall be paid in addition to other charges to prevent disconnection.
(k) After hours service fee. A service fee of $25 will be charged for each separate service call after regular working hours and holidays.
(l) Incremental costs. An amount not to exceed $3.80 per 1,000 gallons is to be used when a bill reflects unusual consumption which can be attributed to eligible leakage on the customer's side of the meter. This rate shall be applied to all such consumption above the customer’s historical usage. The Weirton Area Water Board shall establish a nondiscriminatory policy regarding this provision for leak adjustments.
(m) Multiple occupancy. Where water service to an apartment building or other multiple occupancy building is provided through a master meter, the charge shall be for the total consumption reflected by the meter reading, or the cumulative total of minimum billings for each unit of said apartment building or other multiple occupancy building, whichever is greater.
(n) Customer requested meter test.
1. Meter testing and smart meter profiling are available to all customers. If, upon request from a customer, the city performs a meter test and said test results in a finding that the meter is operating accurately, the customer will be charged $25 for a meter test and $25 for a meter profiling.
2. If the meter test reflects that the meter is inaccurate or faulty, no charge will be made to the customer.
(o) Customer requested recheck of meter reading. If a customer requests a recheck of a meter reading and it is determined that the initial meter reading is correct and substantiated by the recheck, the customer will be charged $10. However, if the recheck of the meter reading reflects that there was an erroneous initial reading, no charge will be made to the customer.
(p) Relocation of water meters. A service charge of $125 shall be charged for a customer's meter to be moved from within a dwelling to an outside meter pit.
(q) Method of payment. Customers may pay their bills with cash, VISA, MasterCard, Discover and Telecheck.
(r) EFT, ACH, credit card and drop box payments. A service charge will be imposed on EFT, ACH, credit card or drop box payments. The amount shall be equal to the actual charges to the utility from the financial institution for processing payment. The Weirton Area Water Board may determine if it will accept other forms of payment.
(s) Security deposit. In accordance with West Virginia law and Public Service Commission rules.
(2) Schedule 2 - fire protection rates.
(a) Applicability. Applicable in all areas served by the city.
(b) Availability of service. Available for public and private fire protection service.
(c) Private rates. Where connections, hydrants, sprinklers, and the like on property are maintained by customer:

(d) Periodic billing. The schedule of rates and charges above may be applied on a monthly, bi-monthly, quarterly, semi-annual or annual basis, provided no lower charges apply.
(e) Public rates. Forty-five dollars per quarter.
(f) The city is entitled to as many fire hydrants as it may deem necessary; the city to furnish the hydrants and to pay for the installation thereof, and the Water Department to take ownership of and maintain the hydrants.
(B) Step 2 rates (to become effective on and after substantial completion of construction of the project or four months prior to initiation of debt service, whichever event should first occur).
(1) Schedule 1.
