§ 941.01 GENERAL PROVISIONS.
   (A)   Description of system. The wastewater system of the city consists of trunk, interceptors and collection sewers laid in streets, alleys, rights-of-way and easements, and a wastewater treatment plant, the location of which is shown upon plans and drawings filed in the Office of the Sanitary Board, and all other appurtenances which are used in whole or in part in connection with the collection, treatment and disposal of wastewater; and all other extensions, additions and improvements which may be made to such system. Its purpose is to provide for the collection and treatment of domestic wastewater and such industrial wastewaters as are permitted by this article, in order to protect the health, safety and general welfare of the residents of the city.
   (B)   Purpose and policy.
      (1)   This article sets forth uniform requirements for direct and indirect contributors into the wastewater collection and treatment system of the city, and enables the city to comply with all applicable state and federal laws required by the Clean Water Act of 1977 and the General Pretreatment Regulations (40 CFR 403).
      (2)   The objectives of this article are:
         (a)   To require use of public sanitary sewers where available, and as per the conditions specified herein;
         (b)   To establish guidelines for the construction and operation of private “on-site” disposal systems;
         (c)   To establish requirements for the design and construction of private sanitary sewers and building sewers;
         (d)   To prevent the introduction of pollutants into the municipal wastewater system which will interfere with the operation of the system or contaminate the resulting sludge;
         (e)   To prevent the introduction of pollutants into the municipal wastewater system which will pass through the system, inadequately treated, into receiving waters or the atmosphere or otherwise be incompatible with the system;
         (f)   To improve the opportunity to recycle and reclaim wastewaters and sludges from the system.
      (3)   This article provides for the regulation of direct and indirect contributions to the municipal wastewater system through the issuance of permits to certain nondomestic users and through enforcement of general requirements for the other users, authorizes monitoring and enforcement activities, requires user reporting, assumes that existing customer's capacity will not be preempted, and provides for the setting of fees for the equitable distribution of costs resulting from the program established herein.
      (4)   This article shall apply to the city and to persons outside the city within the facilities planning area or service area who are, by contract or agreement with the city, users of the Weirton POTW. Except as otherwise provided herein, the Sanitary Board, acting through its Superintendent, shall administer, implement, and enforce the provisions of this article.
