If any person, firm or corporation violates any provision of this article, such person, firm or corporation shall upon Notice to Appear be required to appear before the Municipal Court of the city and, if convicted of a violation of this article, may be fined not less than $100 for the first offense; $200 for the second offense nor more than $500 and/or ordered to perform up to 40 hours of community service. For any third and subsequent offenses of the same violation(s) within 12 months of the previous violation date the municipal court shall fine of $500 per violation thereafter. The municipality has a right to access fines not less than $100 per offense and add $10 a day assessment not to exceed the maximum penalty of $500 per citation.
