§ 557.02 DEFINITIONS.
   For the purpose of this article, the following definitions shall apply.
   GARBAGE, RUBBISH, FILTH AND DEBRIS. Any and all items including, but not limited to, items that would commonly be regarded as items that have been discarded, that should be placed in refuse containers, items that are no longer fit for consumption, items that pose a health risk, items that have begun to or will begin to decay, rust or otherwise become unusable, or any other items that make the property unsightly and unattractive.
   HAZARDOUS TREES, SHRUBS AND PLANTS. Any such growth upon, overhanging or infringing upon a height of eight feet vertical necessary for pedestrians on public sidewalks and 14 feet vertical clearance for vehicular traffic upon public roadways or which endangers pedestrians or vehicles due to damaged, decayed or broken portions of such growth; or obstructs the view at intersections or vehicular traffic.
   HEDGES. A row of bushes/shrubs or small trees planted close together, especially when forming a fence or boundary/any barrier or boundary and shall not exceed the following:
      (1)   Front yard (from the corner of the house to the sidewalk and/or street) shall not exceed four feet in height.
      (2)   Side and back yard shall not exceed six feet in height.
      (3)   Hedges shall not have any other vegetation growing within them.
      (4)   Hedges shall not harbor any other type of debris/garbage within them.
      (5)   Hedges shall not cause visible impairment egress/ingress to neighbor’s property and/or city intersections.
      (6)   Hedges shall not extend onto sidewalk and other rights-of-way.
   NOXIOUS WEEDS. Those plants as defined in W.V. Code, § 19-12D-3(e), and any of the following: Golden Rod, Poison Hemlock, Poison Ivy, Poison Oak, Ragweed, Stinging Nettle, and other plants capable of causing skin reactions upon contact or producing severe allergic or respiratory reactions.
   RANK VEGETATION AND HIGH GRASS. Any growth of weeds or grass reaching a height of ten inches or more on property.
   WEEDS. Any undefined, uncultivated plant that grows in profusion so as to crowd out a desired crop.
