(A) It shall be unlawful for two or more persons to conspire:
(1) To commit any offense against the State of West Virginia or the City of Weirton; or
(2) To defraud the State of West Virginia or the City of Weirton, if, in either case, one of more of such persons does any act to effect the object of the conspiracy.
(B) Nothing in this section shall be construed to supersede, limit, repeal, or affect the provisions of any other federal, state or municipal law. It shall not be a defense to any prosecution under this section that the conduct charged or proven is also a crime under any other provision or provisions of the West Virginia Code, the common law, or city ordinances.
(C) Any person who violates the provisions of this section by conspiring to commit an offense against the State of West Virginia or City of Weirton which is a misdemeanor shall be guilty of a misdemeanor, and, upon conviction thereof, shall be punished by confinement in the county jail for not more than 30 days or by a fine of not more than $500, or, in the discretion of the court, by both such confinement and fine.
