Any person who violates any provision of this article shall be guilty of a misdemeanor and punished as follows:
(A) The first infraction shall result in a fine of no less than $5 nor more than $25.
(B) A second violation within a 12-month period shall result in a fine of no less than $50 nor more than $100.
(C) A fine of no less than $100 nor more than $500 shall be levied for each additional violation of this article within a 12-month period.
(D) Any employee of the city who violates this article may be subject to disciplinary action in lieu of any criminal penalties set forth herein.
(E) Non-compliance with the posting of signs stated in § 108.05 above is not a defense or a mitigating factor to any criminal charges or disciplinary action.
