When city officers transport any criminal defendant to or from the County Courthouses at Wellsburg or New Cumberland, West Virginia, or to or from the Northern Regional Jail, and that defendant is subsequently convicted of any crime he or she was charged with, or of any lesser, included offense, or if the charge is dismissed under circumstances which require the defendant to pay court costs, then that defendant shall pay, as part of the court costs assessed to him or her, an amount equal to the number of miles the defendant was transported by city vehicles times the current mileage reimbursement rate for one mile as provided at Internal Revenue Service Publication 535, or in any legislation under that section.
