§ 50.001  DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BACKFLOW PREVENTION DEVICE. An Ohio EPA approved device to prevent introduction of contaminated water into the village’s water supply system in accordance with the backflow prevention and cross-connection control ordinance of the village (see Chapter 51 of these codified ordinances).
   BUILDING SEWER. The part of the sanitary sewer which connects the plumbing of the house or building to the village sewer.
   BUILDING SUPERVISOR. The billing supervisor of the village’s Utilities Department.
   COMPATIBLE WASTES. Wastewater that conforms to the characteristics of acceptable wastewater as set forth in the sewer use ordinance of the village (see Chapter 52 of these codified ordinances).
   CONNECTION CHARGE. The statutory fee charged, pursuant to R.C. §§ 727.01 and 729.06, for the privilege of connecting to the utility systems of the village. Such a connection shall not be permitted until such charge has been paid in full.
   CONSUMERS. All customers and users of the water supply system or sewerage system, or trash collection service.
   DEPARTMENT. The Village of Waynesville Utilities Department.
   DISTRICT. Utility service area of the village.
   EASEMENT. A grant by the owner of land to the village for a specified use of land for the installation and maintenance of sanitary sewers and/or water mains for an indefinite period of time or as dedicated for public right-of-way.
   FOUNDATION DRAINS. Subsurface drains laid around the foundation of a building, either within or outside of the building foundation for the purpose of carrying ground or subsurface water to some point of disposal.
   GARBAGE. Solid wastes from the preparation, cooking, and dispensing of food, and from the handling, storage, and scale of food products.
   INCOMPATIBLE WASTE. Any waste which is not a compatible waste.
   INSPECTOR. A duly appointed representative of the Utilities Department who is responsible for the enforcement of the specifications and quality of construction.
   MAINTENANCE COST. Those costs, including labor, materials, supplies, equipment, accessories, and appurtenances required to maintain the capacity and performance during the service life of the sewerage system and/or water supply system for which such facilities were designed and constructed.
   NON-PARTICIPANT (PRIVATE CONSTRUCTION). The fee, representing a pro-rated share of original cost, charged upon connection to an existing water supply or sanitary sewer system for any property not participating in the original cost of water or sewer system for any property not participating in the original cost of water or sewer improvements constructed pursuant to a private construction reimbursement contract.
   NON-PARTICIPANT (PUBLIC CONSTRUCTION). The fee charged upon connection to an existing water supply or sanitary sewer system for any property not included in the original assessments of benefit or any property included in the calculation of benefit but subdivided after the levy of assessments.
   NPDES PERMIT. The National Pollutant Discharge Elimination System Permit as issued by the Ohio Environmental Protection Agency.
   OPERATING COST. Those costs, including labor, materials, supplies, equipment, accessories, and appurtenances required to operate the sewerage system and/or water supply system at the level of performance for which such facilities were designed and constructed.
   PERMIT. Evidence of permission to connect to the water supply or sewerage system.
   REPLACEMENT COST. The aggregate cost of obtaining and installing equipment, accessories, or appurtenances which are necessary during the service life of the sewerage system and/or water supply system to maintain the capacity and performance for which such facilities were designed and constructed. The term “operation and maintenance” includes replacement.
   RESIDENCE. A building or house constructed on any lot, parcel of land, or premises and used primarily for dwelling purposes.
   SANITARY SEWER. A sewer that carries liquid and/or water-carried wastes from residences, commercial buildings, industrial plants, and institutions and to which storm, surface, and ground water are not intentionally admitted.
   SEWER USE ORDINANCE. The sewer use ordinance of the village (see Chapter 52 of these codified ordinances).
   SPECIFICATIONS. The construction and material requirements adopted by the subdivision regulations of the village, as adopted by Ordinance 96-106, as from time to time amended and modified (see Chapter 152 of these codified ordinances).
   STORM SEWER. A sewer or drain which carries or disposes of storm and surface waters and drainage, but excludes sanitary sewage and industrial wastes.
   TAPPING CHARGE. A charge for the cost of labor and materials required to tap a water or sewer main and extend a service line from the main to the easement area, including the curb stop, corporation stop, meter pit and meter setter, and sanitary sewer riser pipe.
   USER. Any person, firm, group, or corporation that contributes, causes, or permits the discharge of sanitary sewage into the sewerage system; any person that receives water service directly or indirectly from the village water system.
   USER CHARGE (SERVICE CHARGE). That amount paid by each consumer connected to village utility systems proportionate to the service provided. This charge shall cover all operation, maintenance, and replacement costs for the facilities.
   VILLAGE ENGINEER. The Engineer of the village, or a duly authorized representative.
   VILLAGE MANAGER. The Village Manager of the village, or a duly authorized representative.
   WATER AND SEWER DEPARTMENT. The Village Utilities Department.
   WATER SERVICE LATERAL. That part of the water system which connects the plumbing of a house or building to the water meter.
   WATER SUPPLY SYSTEM. Any or all sources of water supply, pumping equipment, treatment plants, distribution mains, reservoirs, tanks, other equipment and land, rights-of-way, and easements necessary for the proper development and distribution of the supply.
