A. Officers Generally:
1. Compensation: Except as otherwise provided in this code, compensation for elected and appointed officers shall be as fixed by ordinance. Salaries shall not be increased or diminished so as to take effect during the term of any officer holding an elective office and shall be fixed at least one hundred eighty (180) days before the beginning of the term of officers whose compensation is to be fixed. The salaries, fees, or other compensation of any appointed officer, not including those appointed to fill vacancies in elective offices, may be increased but not diminished during the term for which the officer was appointed. No additional compensation shall be paid for performing the duties of office, but officers shall be entitled to reimbursement for expenses lawfully and validly incurred in the discharge of their duties.
2. Oath: Before entering upon the duties of their respective offices, all elected and appointed officers shall take and subscribe the oath or affirmation required by the Illinois constitution, which oath or affirmation shall thereafter be filed in the office of the village clerk.
3. Bonds: Before entering upon the duties of their respective offices, the village president, village clerk, village treasurer, and village attorney shall execute a bond with security, to be approved by the corporate authorities. The bond shall be payable to the village in the penal sum set forth herein, conditioned upon the faithful performance of the duties of the office and the payment of all money received by the officer, according to law and village ordinances. The bond may provide that the obligation of the sureties shall not extend to any loss sustained by the insolvency, failure, or closing of a bank or savings and loan association organized and operating either under the laws of the state or the United States in which the officer has placed funds in the officer's custody, if the bank or savings and loan association has been approved by the corporate authorities as a depository for those funds. Bonds shall be filed with the village clerk, except the bond of the village clerk, which shall be filed with the village treasurer. The penal sum of the bonds of the aforesaid officers shall be ten thousand dollars ($10,000.00), or in the case of the village treasurer an amount not less than three (3) times the latest federal census population or any subsequent census figure used for motor fuel tax purposes, whichever is greater. B. Elected Officers: The terms of all elected officers of the village shall begin at the first regular meeting in May following the proclamation of the results of the election at which the office is filled. (Ord. 11-05, 5-17-2011)
C. Appointed Officers:
1. Appointments: All appointed officers of the village shall be appointed by the president, subject to the advice and consent of the village board.
2. Residency: Except for village engineers, the village attorney or other officers who require technical training or knowledge, and the village treasurer, all appointed officers shall be qualified electors in the village.
3. Term: Except as otherwise provided in this code, all village officers appointed by the village president shall serve for a term of one year, commencing May 1 and ending April 30 of the following year; provided that such village officers shall serve until their successor has been appointed and has qualified, unless sooner disqualified by law.
4. Vacancies: Vacancies in all appointed village offices may be filled in the same manner as appointments are made pursuant to subsection C1 of this section.
5. Reports: Appointed officers shall report to the village president or such other officer or committee as the village board may, by ordinance, or written request provide. From time to time, the village president, village board, or other officer may request, and the appointed officer shall provide, a written report of the status of certain work or projects performed by such appointed officer.
D. Other Positions:
1. Selection: Selections of persons to hold other positions, as designated in Section 1-6-3 of this Chapter, shall be made by the Village President with the concurrence of the Board of Trustees. Persons selected for such positions shall serve at the discretion of the corporate authorities.
2. Residency: Persons selected for other positions, as designated in Section 1-6-3 of this Chapter, shall not be required to be residents of the Village.
3. Compensation: Except as otherwise provided herein, persons selected for other positions, as designated in Section 1-6-3 of this Chapter, shall be compensated in accordance with the Village's annual appropriation ordinance, or pursuant to an agreement between such person and the corporate authorities for compensation as an independent contractor.
4. Reports: Persons selected for other positions, as designated in Section 1-6-3 of this Chapter, shall report to the Village President, or such other officer or committee as the Village Board may, by ordinance, provide. From time to time, the Village President or other officer may request and the person selected shall provide a written report of the status of certain work or projects performed by such person. A. Village Clerk:
1. Office Established: There is hereby created the office of Village Clerk, in accordance with the provisions of section 3.1-25-90 of the Illinois Municipal Code.
2. Compensation: The Village Clerk shall be compensated on an hourly basis as fixed by ordinance, for time actually spent by the Village Clerk in the performance of the Clerk's official duties. The Village Clerk shall report to the Village President by the end of the first business day of each month worked for which pay is claimed under this subsection. A copy of such report shall also be retained in the records of the Village Clerk.
3. Duties: The duties of the Village Clerk shall be as set forth in section 3.1-35-90 of the Illinois Municipal Code.
4. Deputy Village Clerk: The Village Clerk is hereby authorized to appoint one deputy clerk, subject to the approval of the Village Board. The deputy clerk shall have the powers and duties specified in section 3.1-35-95 of the Illinois Municipal Code, and shall serve for such term within the term of office of the Clerk as the Clerk shall determine. Such deputy clerk need not be a resident of the Village.
B. Village Treasurer:
1. Office Established: There is hereby created the office of Village Treasurer in accordance with the provisions of section 3.1-30-5 of the Illinois Municipal Code.
2. Duties: The duties of the Village Treasurer shall be as set forth in sections 3.1-35-40, 3.1-35-45, 3.1-35-50, 3.1-35-60, 3.1-35-65, 3.1-35-70, and 3.1-35-85 of the Illinois Municipal Code.
C. Village Collector:
1. Office Established: There is hereby created the office of Village Collector in accordance with the provisions of section 3.1-30-5 of the Illinois Municipal Code.
2. Duties: The duties of the Village Collector shall be as set forth in sections 3.1-35-120 and 3.1-35-125 of this Illinois Municipal Code.
3. Village Clerk As Collector: Pursuant to section 3.1-35-135 of the Illinois Municipal Code, the appointed Village Clerk shall hold the office of Village Collector for the same term and with the same bond required in connection with such office as is provided for the Village Clerk.
4. Compensation: The Village Clerk shall not be entitled to any compensation as Village Collector other than that which is prescribed by ordinance for the office of Village Clerk; however, the Village Collector shall be reimbursed for actual expenses incurred in connection with the performance of the official duties of such office.
D. Village Attorney:
1. Office Established: There is hereby created the office of village attorney in accordance with the provisions of section 3.1-30-5 of the Illinois Municipal Code.
2. Term: The village attorney shall serve for the term of the village president or until a successor is appointed and has qualified.
3. Duties:
a. Suits, Actions And Judgments: The village attorney shall prosecute and defend any and all suits or actions at law or in equity to which the village may be a party, or in which it may be interested, or which may be brought against, or by, an officer of the village on behalf of the village, or in the capacity of such person as an officer of the village, and shall see to the full enforcement of all judgments, decrees or awards rendered in favor of the village.
b. Advice: The village attorney shall be legal advisor for the village, and shall render advice on all legal questions affecting the village, whenever requested to do so by the village president, village clerk, village treasurer or the board of trustees. Upon specific request by any of the foregoing officers, such opinions shall be reduced to writing.
The chairman of any committee or a majority of such committee of the board of trustees may request an answer to a specific question, and the village attorney shall prepare a written or oral answer to such question to be rendered to the committee.
The chairman of any board or commission, or a majority of such board or commission, may request a written or oral opinion from the village attorney, and the village attorney shall prepare a written or oral opinion in response to such a request.
c. Additional Counsel: The village attorney may employ additional counsel to aid the village in its affairs whenever the village attorney deems it to be necessary or expedient.
d. Ordinances And Documents: The village attorney shall draft or supervise the drafting of all contracts, leases, or other documents or instruments to which the village may be a party, and shall draft all ordinances covering any subjects in which the village has an interest, as required.
4. Compensation: The village attorney shall be compensated in accordance with an agreement made from time to time between such attorney and the corporate authorities.
E. Zoning Enforcement Officer:
1. Office Established: There is hereby created the office of zoning enforcement officer and one or more deputy zoning enforcement officers for the village.
2. Duties: The zoning enforcement officer and any deputy zoning enforcement officers shall have all duties as may be prescribed by state law and the ordinances of the village, as amended from time to time, including such duties as are set forth in section 10-4-2 of this code. F. Director Of Building And Zoning:
1. Office Established: There is hereby created the office of director of building and zoning for the village.
2. Duties: The director of building and zoning shall perform such duties as may be prescribed by state law and the ordinances of the village, as amended from time to time, including the duty to enforce all building codes, ordinances and regulations of the village.
3. Director Of Building And Zoning As Zoning Enforcement Officer: The director of building and zoning may also hold the position of zoning enforcement officer if the corporate authorities so determine. (Ord. 99-07, 3-16-1999; amd. Ord. 00-19, 9-5-2000)
A. Solid Waste Coordinator:
1. Position Established: There is hereby created the position of solid waste coordinator for the village.
2. Duties: The solid waste coordinator shall oversee the management of the village recycling programs; act as liaison to other units of government relative to solid waste recycling, management, regulation, or related areas; prepare any reports required by ordinance or intergovernmental agreement relating to solid waste recycling within the village for transmittal by the village clerk or any other officer charged with final responsibility for such reports; and assist the village president with respect to other relevant projects which the president may deem appropriate to assign to the solid waste coordinator.
3. Compensation: The solid waste coordinator shall serve without compensation but may be reimbursed for actual expenses incurred in conjunction with the performance of the coordinator's duties.
4. Access To Village Services, Facilities And Personnel: The solid waste coordinator shall be entitled to access to the village hall and to all services, facilities and personnel of the village necessary to the performance of the duties of the position, as determined by the village president.
B. Coordinator Of Special Projects:
1. Position Created: There is hereby created the position of coordinator of special projects in the village.
2. Duties: The coordinator of special projects shall have the responsibility for such specific projects as the village president or the board of trustees shall, from time to time, assign and which the coordinator agrees to undertake.
3. Compensation: The coordinator of special projects shall serve without compensation but may be reimbursed for actual expenses incurred in conjunction with the performance of the coordinator's duties.
4. Access To Village Services, Facilities And Personnel: The coordinator of special projects shall be entitled to access to the village hall and to all services, facilities and personnel of the village necessary to the performance of the duties of the position, as determined by the village president.
C. Special Assistant To The Village President:
1. Position Created: There are hereby created positions of special assistant to the village president, not to exceed three (3) special assistants at any one time.
2. Duties: Special assistants to the village president shall have such responsibilities for specific projects as the village president or the board of trustees may, from time to time, assign to them and which they agree to undertake. Such assignments may include assignments or projects to be carried on under the direction of the coordinator of special projects.
3. Compensation: Each special assistant to the village president shall serve without compensation but may be reimbursed for actual expenses incurred in conjunction with the performance of such assistant's duties.
4. Access To Village Services, Facilities And Personnel: Each special assistant to the village president shall be entitled to access to the village hall and to all services, facilities and personnel of the village necessary to the performance of the duties of the position, as determined by the village president.
