§ 98.12 TREE REMOVAL.
   (A)   The owners of property with trees located between the sidewalk and the paved portion of a public road within the public right-of-way may request the town that said tree be completely removed.
   (B)   The property owner shall make a written application for the tree removal permit, which application shall be made to the office of the Clerk-Treasurer, and shall be made on a form provided by the Clerk-Treasurer. The application shall state the location of the tree proposed to be removed along with the reason for the proposed removal. The applicant shall also submit satisfactory proof of ownership of the property upon which said tree is located.
   (C)   The application must be reviewed and approved by the Superintendents of Street, Water, and Waste Water for the purpose of locating all town utilities and providing for their protection during the tree removal.
   (D)   The tree, stump, and all wood, brush, and debris shall be removed by the town through its contractor and the expense for such services must be paid by the property owner prior to removal.
   (E)   The property owner shall immediately thereafter clean up and reseed the area.
   (F)   Any planting of trees, replacement or otherwise, within the area between the sidewalk and the paved or traveled portion of any public street within the public right-of-way shall be done pursuant to other local ordinances.
