AN ORDINANCE AMENDING THE CITY OF WATERLOO TRAFFIC CODE BY REPEALING SECTION 4, OF SECTION 582, TRUCK TRAFFIC PROHIBITED ON CERTAIN STREETS, AND ENACTING IN LIEU THEREOF A NEW SECTION 4, OF SECTION 582, TRUCK TRAFFIC PROHIBITED ON CERTAIN STREETS.
 
   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA AS FOLLOWS:
   SECTION 1. REPEALING SECTION 4.
   The current Section 4, of Section 582 titled “TRUCK TRAFFIC PROHIBITED ON CERTAIN STREETS” is hereby repealed in its entirety.
   SECTION 2. NEW SECTION 4.
   A new Section 4, of Section 582 shall be enacted as follows:
SEC. 582    TRUCK TRAFFIC PROHIBITED ON CERTAIN STREETS.
1.    Definition. No person shall operate a motor truck or special mobile equipment with a maximum weight of over ten (10) tons over or upon the streets or portions of streets hereinafter designated except when making a delivery to a place located upon said street or portion thereof and this entrance shall be made from the nearest intersection where said delivery is to be made.
2.   Exceptions. Nothing in this section shall prevent the operation of a light delivery truck, panel delivery truck, or pick-up truck thereon.
3.   Prohibited Streets. Truck traffic, except as defined herein, is prohibited on the following Streets:
      STREET           PORTION WHERE TRUCK TRAFFIC IS PROHIBITED
(1)   RESERVED.
 
4.   Signage. Appropriate signage shall be installed and maintained to inform road users of these restrictions, ensuring readability and compliance with all applicable traffic control standards.
 
SECTION 3. REPEALER CLAUSE.
All ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed.
 
SECTION 4. SEVERABILITY CLAUSE.
If any section, provision or part of this chapter shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of this chapter as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
 
SECTION 5. EFFECTIVE DATE.
This ordinance shall be in full force and effect from and after its final passage, approval, and publication as required by law.
