§ 117.16 APPLICATION AND FEE; NOTIFICATION OF DENIAL.
   (A)   Filing of application; fee. Each applicant for an operator's permit shall file an application with the Superintendent of Police and pay a filing fee which shall not be refundable. The fee shall be set, from time to time, by the Board of Aldermen and a schedule of the fees will be on file in the Town Clerk's Office.
   (B)   Contents of application. The application for a permit to operate a massage establishment shall be in writing, signed and sworn to by the applicant, and shall set forth:
      (1)   The name and address of each applicant;
      (2)   That the applicant is at least 18 years of age;
      (3)   The proposed place of business and facilities therein;
      (4)   The exact nature of the massage to be administered;
      (5)   Two portrait photographs of the applicant at least two inches by two inches and a complete set of the applicant's fingerprints. The fingerprints shall be taken by the Police Department;
      (6)   Business, occupation or employment history of the applicant for the three years immediately preceding the date of application;
      (7)   Massage or similar business license history of the applicant for the three years immediately preceding the date of the application;
      (8)   Any criminal conviction, except minor motor vehicle violations;
      (9)   Plans for the physical layout of the massage establishment prepared by a professional architect;
      (10)   If the applicant is not a practitioner of massage then the application shall designate a permitted practitioner of massage to be the agent of the principal owner and operator and to be in constant direct and personal supervision of the establishment;
      (11)   A list of all persons having a beneficial financial interest in the massage establishment and the amount of each person's interest if 10% or more. If a corporation holds 10% or more, the names and addresses of the corporate officers, directors and shareholders;
      (12)   Appropriate certificates, licenses and the like showing proper compliance with all the applicable rules, regulations, ordinances and statutes including zoning, building and health laws and regulations;
      (13)   A written statement of operating policies and procedures pertaining to such matters as times of operation, accessibility, personnel policies, safety and health of clients and employees; and
      (14)   Such other information as may be required by § 117.05 in order for the Superintendent of Police to carry out the doctrines of this chapter.
   (C)   Filing of application; notification of denial. Application for a permit to conduct a massage establishment shall be submitted to the Superintendent of Police 90 days in advance of the opening for operation of the establishment. Any permit issued under these regulations shall be valid until the next renewal date unless suspended or revoked. Upon the denial of an application for an original permit, the Superintendent of Police shall notify the applicant in writing of the denial by the mailing of a notice to the applicant at the address shown on his application.
