§ 38.162 APPLICATION OF THIS CHAPTER.
   (A)   General application. This chapter applies only to contracts and purchase orders solicited or entered into after the effective date of this chapter unless the parties agree to its application to a contract solicited or entered into prior to the effective date.
   (B)   Application to city procurement.
      (1)   Subject to those provisions of the Charter of the city that may be applicable to transfers of items of value or property in which the city may have an interest, this chapter shall apply to the transfer of items of value or property, in which the city may have an interest, and every expenditure of public funds irrespective of their source, including federal and state assistance monies, except as otherwise specified in order to comply with specific state or federal requirements, by this city acting through a using agency, as defined herein, under any contract.
         (a)   Intergovernmental relations exemption. Sections 38.100 to 38.102 shall not apply to either grants or contracts between the city and state or other governments, which shall be governed hereby pertaining to intergovernmental relations.
         (b)   Disposal of city supplies. This chapter shall apply to the disposal of city supplies as set forth herein.
      (2)   Nothing in this chapter or in the regulations or rules promulgated hereunder shall prevent any agency from complying with the terms and conditions of any grant, gift, bequest or cooperative agreement, to the extent the compliance is otherwise lawful and not contrary to public policy.
