§ 38.046 RESPONSIBILITY OF BIDDERS AND OFFERORS.
   (A)   Determination of nonresponsibility. The Director of Purchasing shall make a determination of nonresponsibility of a bidder or offeror. The unreasonable failure of a bidder or offeror to promptly supply information in connection with an inquiry with respect to responsibility may be grounds for a determination of nonresponsibility with respect to the bidder or offeror. The Director of Purchasing may seek the advice of the using agency and the consultants, if any. If requested by the bidder or offeror deemed nonresponsible the Director of Purchasing may provide a written determination.
   (B)   Right of nondisclosure. To the extent permitted by the state general statutes, confidential information furnished by a bidder or offeror pursuant to this chapter shall not be disclosed outside of the Department of Purchases without prior written consent by the bidder or offeror.
