§ 37.120 VOLUNTARY DEMOTIONS.
   (A)   Employee request.
      (1)   An employee may be demoted at his own request to a vacant position in a lower class subject to the approval of the Director of Human Resources.
      (2)   The Director of Human Resources shall determine whether the employee is qualified to perform the duties and responsibilities of the lower classification.
   (B)   Pay grade after voluntary demotion. Any employee who voluntarily requests to be demoted or transferred to his former position, a comparable one in which he has satisfactorily completed his working test period or to a position in a lower pay grade (in which position the Director of Human Resources approved the employee’s compliance with the specifications) shall, subject to the approval of the Human Resources Director, be placed on that step in the pay range for the position to which he is demoted or transferred that he would have attained, except for the period he held the position from which he was voluntarily demoted or transferred.
