§ 37.088 SELECTION OF EMPLOYEES FOR APPOINTMENT AND PROMOTION.
   (A)   The rule of one. The rule of one shall apply to the initial appointment of all candidates for entry-level appointments to sworn positions at the Police and Fire Departments.
      (1)   Standard of selection. The Director of Human Resources shall certify the highest ranking person on the appropriate eligible list to fill a vacancy(ies).
      (2)   Tie break for police and fire entry examinations. For police and fire entry examinations, when two or more applicants receive the same final score, the following criteria shall be applied to break the tie for rank: The applicant having scored highest on that phase of the examination bearing the most weight (or if necessary, the next highest weighted examination component, and so on) shall rank ahead and if the tie persists, the applicant scoring highest on the first examination phase administered (or if necessary, the second phase administered, and so on) shall rank ahead and if the tie persists, the applicant who is a resident of the city shall rank ahead. If the tie persists, it shall be broken by a random method to be prescribed by the Human Resources Director, subject to the approval of the Civil Service Commission.
   (B)   The rule of three. The rule of three shall apply to the initial appointment and promotion of all other employees of the city and to the promotion of all sworn employees of the Police and Fire Departments, with the exception of those employees subject to the rule of five, as set forth in § 37.071.
      (1)   Standard of selection. The Director of Human Resources shall certify the three highest scoring persons in alphabetical order on the appropriate eligible list to fill a vacancy.
      (2)   Number of names to be certified. When a personnel requisition is received for all positions, except entry-level police and fire positions, the Director of Human Resources shall certify the top three scorers including those individuals tied with the third scorer from an eligible list. The Director shall file the certified names with the appropriate appointing authority. In the event the appointing authority is a board or commission the listing shall be filed with the appropriate department head or, in the case of the Board of Aldermen, the President.
   (C)   Withdrawal or removal from certification list.
      (1)   In the event a candidate withdraws or is removed by the Director of Human Resources, pursuant to the rules, prior to interview, then the next highest scoring candidate(s) shall be certified.
      (2)   If a candidate withdraws or is removed after the interview, then the appointing authority may request additional candidates or make a selection from those interviewed.
   (D)   Regulations regarding examinations. In accordance with § 6B-4(c)(1)(iii) of the Charter of the city, the Civil Service Commission shall establish regulations pertaining to the standards established for examinations.
   (E)   Role of the Director of Human Resources. In the event an eligibility list is diminished to fewer than the minimum number of candidates for appointment and promotion, as set forth in this section, the list shall be deemed null and void; unless the Director of Human Resources certifies that the number of individuals who applied for the job in accordance with the dates set in the job posting were fewer than the minimum number of candidates on the eligibility list.
