§ 37.074 APPOINTMENT OF ADMINISTRATIVE OFFICIALS BY CERTAIN DEPARTMENT HEADS.
   (A)   Objective. In order to execute the administrative and operational policies and priorities of their respective departments, the Superintendent of Police, the Chief Engineer of the Fire Department and the Director of Public Works may appoint the unclassified administrative officials set forth in division (B) below.
   (B)   Appointing authorities. For purposes of this section, the department heads set forth in division (A) above shall be deemed the appointing authority of the following unclassified administrative officials:
      (1)   Deputy Superintendent of Police. The Deputy shall have held the permanent rank of lieutenant, or above, in the city. If no internal candidate is willing to serve or, if the Superintendent determines that no qualified internal candidate is available and acceptable to the Superintendent, the Superintendent may appoint a deputy from a state or municipal police force where the job experience would be comparable, qualitatively and quantitatively to the rank of lieutenant or above in the city.
      (2)   Assistant Chief Engineer of the Fire Department. The Assistant shall have held the permanent rank of battalion chief, or above, in the city. If no internal candidate is willing to serve or, if the Chief Engineer determines that no qualified internal candidate is available and acceptable to the Chief Engineer, the Chief Engineer may appoint an assistant from a state or municipal fire department where the job experience would be comparable, qualitatively and quantitatively to the rank of battalion chief or above in the city.
      (3)   Deputy Public Works Directors for Operations and Services. The Deputies shall have held the position of department head or Bureau Chief. If no internal candidate is willing to serve or, if the Director determines that no qualified internal candidate is available and acceptable to the Director, the Director may appoint an external candidate whose job experience would be comparable, qualitatively and quantitatively, to the position of department head or Bureau Chief.
   (C)   Term of unclassified administrative officials. The unclassified administrative officials set forth in division (B) above shall serve at will.
