§ 37.023 CLASSIFIED SERVICE.
   (A)   The divisions of the classified service. The classified service shall include all other positions now existing or hereafter created and shall be divided into competitive and noncompetitive divisions.
      (1)   The noncompetitive division. The noncompetitive division shall include: the following positions or classes of positions for which the Civil Service Commission, by unanimous vote of all of its members, decides that it is not practicable to determine the relative merit and fitness of applicants by competitive examination:
         (a)   Cashier Checker;
         (b)   Checker;
         (c)   Lakewood Park Supervisor;

         (d)   Lifeguard I;
         (e)   Lifeguard II;

         (f)   Park Cashier;
         (g)   Playground Leader I;
         (h)   Playground Leader II;
         (i)   Recreation Aide;
         (j)   Recreation Leader I;
         (k)   Recreation Specialist;
         (l)   Swim Program Director;
         (m)   Water Safety Supervisor;
         (n)   Fire Driver;
         (o)   Police Officer (currently certified);
         (p)   Temporary Employees; and
         (q)   Other season classifications.
      (2)   The competitive division. The competitive division shall include all other offices or positions of the Classified Service.
   (B)   Determination of placement in noncompetitive division. The Civil Service Commission may, at any time, by a majority vote, designate the position or class of positions which shall be placed in the noncompetitive division. The designation shall be effective following ratification of the designation by a majority vote of the Board of Aldermen.
   (C)   Determination of placement from noncompetitive to competitive division: discretion of Commission.The Civil Service Commission may, at any time, by a majority vote, change a position or class of positions from the noncompetitive to the competitive division.
