§ 37.005 DEPARTMENT OF HUMAN RESOURCES.
   (A)   The Director of Human Resources. The day-to-day management of the Department shall be vested in the Director of Human Resources.
      (1)   Appointment. The Director of Human Resources shall be a properly qualified person appointed, as prescribed herein. The Director of Human Resources shall become a member of the classified service, except for the removal provisions specified herein.
      (2)   Removal of the Director. The Director of Human Resources may be removed only for misfeasance, nonfeasance or partisan activity upon notice in writing of the reason for such removal and an opportunity to be heard in his own defense before the Civil Service Commission, and upon a majority vote of the full Commission.
         (a)   Appeal by the Director. A Director of Human Resources so removed may appeal the decision of the Civil Service Commission to the Board of Aldermen by filing grounds for appeal within the time period set forth in the code of ordinances or the rules of the Board of Aldermen.
         (b)   Action by the Board of Aldermen. The Board of Aldermen may reverse the decision of the Civil Service Commission, after considering the grounds for appeal; provided, at least ten Aldermen vote in favor of the reversal. The actions of the Board of Aldermen shall be in the manner of an appellate and not a de novo proceeding.
      (3)   Duties of the Director. The duties of the Director are set forth in § 7C-5 of the Charter of the city and may be amplified by ordinance.
   (B)   Records and reports of personnel transactions. All appointments, separations and other personnel transactions must be made on forms as designated by the Director of Human Resources.
      (1)   Public inspection. The following information relative to employees and former employees is available for public inspection at reasonable times and in accordance with procedures prescribed by the Director of Human Resources: name, address, class title and salary, and eligible lists. The department head concerned, the Mayor, the Civil Service Commission, and the employee involved are the only ones who may access examination records and service rating reports provided that test security is not compromised. Other personnel information may be made available for official purposes only at the discretion of the Director of Human Resources and in accordance with state law.
      (2)   Destruction of records. Eligible lists and employee service records shall be kept pursuant to statutory requirements.
      (3)   Reports. The Director of Human Resources shall submit a written report to the Civil Service Commission annually and at such other times as the Commission shall designate. Copies of the reports shall be sent to the Mayor and Board of Aldermen.
      (4)   Attendance records. Each department shall prepare and submit regular attendance reports of classified employees, as required by the Director of Human Resources.
