§ 130.19 PROHIBITING SMOKING IN ALL CITY BUILDINGS AND VEHICLES.
   The Surgeon General of the United States, citing authoritative medical studies, has recognized the harmful effects of secondary smoke to all persons.
   (A)   Recognizing that the smoking of tobacco or any other product is a danger to health and is a cause of material annoyance and discomfort to those who are present in confined places, the Common Council here by declares that the smoking of tobacco or any other product within any building owned and/or occupied by the City of Washington, and in any vehicle owned by the City of Washington, is hereby prohibited.
   (B)   All departments shall post signs in conspicuous places about their respective premises advising of the prohibition against smoking.
   (C)   Any person who violates this section shall be liable for a civil penalty not to exceed $100, which penalty shall be assessed and recovered in a civil action brought in the name of the City of Washington in a court of competent jurisdiction.
   (D)   Any employee of the City of Washington who violates this section shall, in addition to being liable for the civil penalty referenced in division (C) above, may also be disciplined by his or her department head, which discipline may include but not be limited to warning, reprimand, suspension with or without pay, or termination of employment.
