(A) In the event the requirements of § 98.05 are not fully and completely complied with, there shall be placed a lien upon the real estate of the individual(s) who hired the limb trimming or tree cutting; the noncomplying individual, business concern or corporation shall be liable for liquidated damages to the city in the sum of $10,000 in lieu of compensatory damages sustained to the city as a result of any expense incurred by actions of the noncomplying perpetrator; or the individual, business concern or corporation shall be deemed to have committed a Class C Misdemeanor under I.C. 35-50-3-4, the election of the above-referenced penalties to be the city's.

(B) Any person who violates any of the provisions of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
