§ 70.04 OPERATING VEHICLE AS A NUISANCE PROHIBITED; DUTY OF POLICE DEPARTMENT.
   (A)   It shall be hereafter unlawful to operate within the corporate boundaries of the city, at any time, at any place or in any manner other than upon the public thoroughfares, streets and roadways of the city, any 2, 3, 4 or multi-wheeled vehicles which are unregistered and/or unlicensed and are recreational and/or off-road, or all-terrain variety vehicles if the vehicles, by and through, or as a result of their use, create dust, noise, or create any other nuisance as to cause property owners or property occupiers to complain of the same, or if, in the discretion of any authorized individual on behalf of the city to conclude that operation of the vehicles creates noise pollution, dust pollution or results in any other nuisance to area landowners/occupiers.
   (B)   The City Police Department shall be authorized to enforce the provisions and dictates of this section, and after investigating any complaints and after there has been a determination by the City Police Department that the operation of the vehicles as described in division (A) of this section on property other than public streets and thoroughfares is in fact creating a noise pollution and/or dust pollution, and/or nuisance of any other variety, shall order the operator of the vehicle(s) to cease and desist operation immediately.
