10-4-1: TERMS DEFINED:
For the purpose of this title, certain words and terms are defined as follows:
Words used in the present tense include the future; words in the singular number include the plural, and words in the plural include the singular; words not included herein but defined in the Building Code shall be construed as defined therein.
ACCESSORY BUILDING:
A detached subordinate building, incidental and subordinate to, and located on the same lot as the main or primary building. Accessory building includes workshop, garage, barn, pool house, shed, gazebo, pavilion, or similar building without habitable space, as defined in the international building code (IBC); a wash sink and/or toilet may be permitted within an accessory building. An accessory building may be permitted concurrently with, but not prior to, the main or primary building.
ADULT DAYCARE FACILITY:
Any building or structure furnishing care, supervision and guidance for three (3) or more adults unaccompanied by a guardian for periods of less than twenty four (24) hours per day.
AGRICULTURAL BUSINESS:
A business that is primarily engaged in a use that relates to the tilling of soil and raising of crops, or keeping or raising domestic animals.
AGRICULTURE:
Land devoted to the raising of useful plants and animals with a reasonable expectation of profit, including, forage and sod crops, grain and feed crops, nut and fruit crops, vegetables, nursery, floral and ornamental stock, livestock animals, including domestic animals, poultry and honeybees. "Agricultural land" also includes land devoted to and meeting the requirements and qualifications for payments or other compensation under a cropland retirement program with an agency of the state or federal government.
AGRICULTURAL TOURISM (AGRITOURISM):
Agriculturally related accessory uses designed to bring the public to a working farm, ranch, or other commercial agricultural, aquacultural, horticultural, or forestry operation for the enjoyment of, education about, or participation in agricultural activities such as: farm animal viewing and petting, wagon rides, corn maze, tree farm, pumpkin patch, winery tours and wine tasting, farm or ranch activities tours, horticulture nurseries and associated display gardens, provide recreation, entertainment and educational experiences, classes or workshops and similar uses.
AIR CONDITIONING, SALES AND SERVICE:
An establishment that buys, sells, trades, and/or repairs air conditioning systems and accessories.
AIRPORTS:
Any area of land or water designed and set aside for the landing and take-off of aircraft, including all necessary facilities for the housing and maintenance of aircraft.
ALTERING, PRESSING AND REPAIRING OF WEARING APPAREL:
An establishment that its primary business is for tailoring.
AMBULANCE SERVICES:
A privately-owned facility for the dispatch, storage, and maintenance of emergency medical care vehicles. The term "ambulance service" shall encompass emergency ambulance service and routine ambulance service.
AMUSEMENT ENTERPRISES:
A business facility that is maintained or operated for the amusement, patronage, or recreation of the general public. The amusement activity may be either a principal or secondary business, and may be located either indoors or outdoors. Accessory uses may include the preparation and serving of food, and the sale of equipment related to the included uses.
ANIMAL HOSPITAL:
For small animals only. All services must be provided and conducted within a completely enclosed building.
ANIMAL NUMBERS:
The number of animals does not include newborn animals under the age of six (6) months, or newborn animals that are dependent upon their mother for sustenance of life, whichever is greater, that were born by animals kept on the property by the owner of the property, or a tenant of the property.
ANIMAL SIZE:
The categorizing of animals is based upon a classification of large or small animals. The determination may be made by size of animal, irrespective of species or genetic makeup at the discretion of the planning commission. The keeping of animals must conform with good animal practices. The keeping of animals and fowl for family food production or personal use, but not for commercial use, is permitted if used in connection with a single-family dwelling in a residential zone. In no event shall the property owner be allowed to keep in excess of the following in a residential zone:
A.   One (1) large animal for every twelve thousand five hundred (12,500) square feet of area not to exceed a maximum of four (4) large animals on any residential zoned lot not located in the RA-2.5, RA-5 and RA-10 Residential Agricultural zones. Lots located in the RA-1, RA-2.5, RA-5 and RA-10 zones are not bound to a maximum number of large animals as long as the square footage standard of one large animal for every twelve thousand five hundred (12,500) square feet is met. Large animals may include horses, cattle or other animals judged by the planning commission to be compatible with this category of livestock.
B.   Three (3) medium animals shall equal one large animal. Medium animals shall include goats, sheep, and horses or ponies that are smaller than thirty six inches (36") in height, measured from the withers, or other animals judged by the planning commission to be compatible with this category of livestock and which are indigenous to the agricultural area and are not exotic animals.
C.   Not more than eight (8) poultry or rabbits or other small animals for every twelve thousand five hundred (12,500) square feet of area, not to exceed thirty (30) poultry or rabbits on any lot.
D.   No pigs, other than weaner pigs, nor any exotic animals shall be kept on any lot within a residential zone other than RA (Residential Agricultural) zones. Due to impact pigs are considered large animals and must meet the large animal standard found in Animal Size definition.
APARTMENT RENTAL DEVELOPMENTS:
A building or structure arranged, intended, and designed to be occupied by three or more families living independently of each other, and each including its own separate kitchen and bathroom accommodations.
ART GALLERY:
An establishment engaged in the sale, loan, or display of art books, paintings, sculpture, or other works of art. This clarification does not include libraries, museums, or non-commercial art galleries.
ASSISTED LIVING FACILITY:
A residential facility, licensed by the state of Utah, with a homelike setting that provides an array of coordinated supportive personal and healthcare services, available twenty-four (24) hours per day, to residents who have been assessed under rules of the Utah department of health or the Utah department of human services to need any of these services. Each resident shall have a service plan based on the assessment, which may include: a) specified services of intermittent nursing care; b) administration of medication; and c) support services promoting resident's independence and self-sufficiency. Such facility does not include adult daycare provided in conjunction with a residential facility for elderly persons or a residential facility for persons with a disability.
ATHLETIC AND SPORTING GOODS STORE:
Excluding sale or repair of motor vehicles, motorboats or motors. An establishment that sells sporting accessories and equipment at retail.
ATHLETIC CLUB:
A group formed for the purpose of playing sports.
AUCTION ESTABLISHMENT (retail goods only):
A building, area, or areas where any sale where tangible personal property is sold by an auctioneer who is either the agent for the owner of such property or is in fact the owner thereof.
AUTOMOBILE, NEW OR USED SALES AND SERVICE:
The use of any building or portion thereof, or other premises or portion thereof, for the display, sale, rental, or lease of new motor vehicles, or used motor vehicles.
AUTOMOBILE PARTS SALES (NEW):
Stores selling new automobile parts, tires, and accessories. Does not include tire capping establishments.
AUTOMOBILE RENTAL:
Leasing or renting of automobiles, motorcycles, and light load vehicles.
AUTOMOBILE REPAIR:
Including paint, body, fender, brake, muffler, upholstery or transmission (completely enclosed building). A completely enclosed facility for the general repair, rebuilding or reconditioning of engines, motor vehicles, or trailers, or providing collision services, including paint, body, fender, brake, muffler, upholstery, or transmission.
AUTOMOBILE STORAGE YARD. NOT SALVAGE YARDS:
An area where motor vehicles are placed for more than twenty four (24) hours.
BANK OR FINANCIAL INSTITUTION:
An organization involved in deposit banking, finance, investment, mortgages, trusts, and the like, but excluding uses specifically classified in another definition herein. Typical uses include commercial banks, credit unions, finance or mortgage companies, and savings institutions.
BARBERSHOP:
A fixed establishment or place where one or more persons engage in the practice of barbering.
BASEMENT:
A story partly underground. A basement shall be counted as a story for purposes of height measurement if its height is one-half (1/2) or more above grade.
BEAUTY SHOP:
Any establishment where cosmetology services are provided including hair care, nail care, and skin care on a regular basis for compensation.
BEER PARLOR, SALE OF DRAFT BEER, BILLIARD PARLOR:
A commercial establishment open to the general public which sells and serves intoxicating beverages for consumption on the premises.
BICYCLE SALES AND SERVICE:
An establishment that sales, and repairs bicycles.
BOAT SALES AND SERVICE:
An establishment where boats are sold and repaired.
BOARDER:
A person living in a rented room in a boarding house. The boarding house operator or a member of his or her immediate family who resides on the premises with the operator shall not be considered to be a "boarder".
BOARDING HOUSE:
A building or portion thereof where, for compensation, rooms are rented, together with meals for not more than fifteen (15) boarders who generally do not directly utilize kitchen facilities. The operator of a boarding house must reside on the premises of a "boarding house". The word "compensation" shall include compensation in money, services or other things of value. A "boarding house" does not include a residential facility for disabled persons or a residential facility for the elderly. A boarding house does not include a nonresidential facility such as a rehabilitation/ treatment facility, where the primary purpose of the facility is to deliver rehabilitation, treatment, counseling, medical, protective or other similar services to the occupants.
BONA FIDE FARM BUILDINGS:
Buildings used solely for farm purposes.
BOOKSTORE, RETAIL:
A retail establishment that, as its primary business, engages in the sale, rental, or other charge-for-use of books, magazines, newspapers, greeting cards, postcards, excluding any "adult bookstore," and "adult theater".
BOWLING ALLEY:
An establishment that devotes floor area to bowling lanes, equipment, and playing area.
BUILDING:
Any structure having a roof supported by columns or walls, for the housing or en-closure of persons, animals or chattels.
BUILDING, ACCESSORY:
See definition of Accessory Building.
BUILDING MATERIALS SALES:
An establishment used for the purpose to sell any material which is used for construction purposes.
BUILDING, HEIGHT OF:
The vertical distance from the grade to the highest point of the coping of a flat roof or to the deck line of a mansard roof, or to the height of the highest peak of a pitched or hipped roof. The reference datum shall be selected by one of the following, whichever yields the greatest height of building:
A.   The elevation of the highest adjoining sidewalk or ground surface within a five foot (5') horizontal distance of the exterior wall of the building when such sidewalk or ground surface is not more than ten feet (10') above the lowest grade.
B.   An elevation ten feet (10') higher than the lowest grade when the sidewalk or ground surface described in subsection A of this definition is more than ten feet (10') above grade.
C.   The height of a stepped or terraced building is the maximum height of any segment of the building.
BUILDING, MAIN:
The principal building or one of the principal buildings upon a lot, or the building or one of the principal buildings housing the principal use upon a lot.
BUILDING, PUBLIC:
A building owned and operated or owned and intended to be operated by a public agency of the United States of America, of the state of Utah, or any of its subdivisions.
BUREAU OF LAND MANAGEMENT LAND:
Land that is owned by the Bureau of Land Management.
BUS TERMINAL:
Any premises for the transient housing or parking of motor-driven buses, and the loading and un-loading of passengers.
CABINET SHOP:
A building for the manufacturing, repairing or refinishing of furniture or wood products for retail or wholesale.
CAFÉ:
An informal restaurant primarily offering coffee, tea, and other beverages, and where light refreshments and limited menu meals may also be sold.
CAFETERIA:
A restaurant or dining room in a school or a business in which customers serve themselves or are served from a counter and pay before eating.
CAMPGROUND:
An area used commercially for temporary or transient occupancy by camping in tents, camp trailers, travel trailers, RV, motor homes, or similar movable or temporary sleeping quarters of any kind that are brought in and out with each visitor. A facility where the sleeping quarters are more permanent in nature, or provided by the property owner, is not a campground. A facility where ten percent (10%) or greater of the total number of sites accommodate an RV or motorhome with utility hookups is considered an RV park and shall be in a zone that permits an RV park, meeting all the requirements of 10-8G MH (Manufactured Housing Park and Recreational Vehicle Park) zone. The length of stay limit for camping is fourteen consecutive days.
CAMPGROUND, TENT SITE:
One tent site is defined as a designated area in a campground for one tent pad, camp trailer, travel trailer, RV, motorhome or similar movable or temporary sleeping quarter. Regardless of the type of sleeping quarter, each tent site equals one unit of density.
CAMP SITE, ISOLATED:
An isolated camp site is in a remote location for temporary, short term camping stays in temporary structures. These sites are intended to be dispersed in back country locations that may only be accessible via hiking, mountain bike or horseback and require all supplies, equipment, water, garbage and waste to be brought in and out with each visitor. Isolated camp sites proposed to be located on public lands must be approved or permitted by the land agency. A camp site located on designated public lands do not require approval from Washington County applicable land use authority.
CAR WASH, MANUAL SPRAY:
A structure with hand operated facilities used principally for cleaning, washing, polishing or waxing of motor vehicles.
CARETAKERS DWELLING, INCIDENTAL TO A COMMERCIAL USE:
An accessory dwelling on a nonresidential premise, occupied by the person who oversees the nonresidential operation twenty four (24) hours a day and his or her family.
CARETAKERS DWELLING, INCIDENTAL TO THE USE OF THE LAND FOR INDUSTRIAL PURPOSES:
An accessory dwelling on a nonresidential premise, occupied by the person who oversees the nonresidential operation twenty four (24) hours a day and his or her family.
CARPET AND RUG CLEANING:
An establishment that primarily cleans carpets and rugs and stores the equipment and cleaning supplies to do so.
CARPORT:
A private garage not completely enclosed by walls or doors. For the purposes of this title, a carport shall be subject to all of the regulations prescribed for a private garage.
CATERING ESTABLISHMENT:
An establishment that serves and supplies food to be consumed off premises.
CATTERY:
An establishment having three (3) or more cats for the purpose of boarding, breeding, buying, grooming, adopting, or selling.
CEMETERIES:
A place designated for the burial or keeping of the remains of the dead, whether human or animal, including crematories and mausoleums.
CHILD NURSERY:
An establishment for the care and/or instruction, whether or not for compensation, of six (6) or more children other than members of the family residing on the premises.
CHURCH:
A building, together with its accessory buildings and uses, maintained and controlled by a duly-recognized religious organization where persons regularly assemble for worship.
CLINIC, MEDICAL OR DENTAL:
A facility operated by one or more physicians, dentists, chiropractors or other licensed practitioners of the healing arts for the examination and treatment of persons solely on an outpatient basis.
CLUB, PRIVATE:
An organization, group or association supported by the members thereof, the sole purpose of which is to render a service customarily rendered for members and their guests, but shall not include any service, the chief activity of which is customarily carried on as a business, and does not include labor union organizations or similar labor or business organizations.
CLUB, PUBLIC:
Buildings and facilities, owned or operated by a corporation, association, person, or persons, for a social, educational, or recreational purpose, to which membership is required for participation, and not primarily operated for profit nor to render a service that is customarily carried on as a business.
COMMUNITY CORRECTIONAL FACILITY:
A facility licensed by or contracted by the State of Utah to provide temporary occupancy for previously incarcerated persons which assists such persons in making a transition from a correctional institution environment to independent living. Such facility may also provide ancillary, temporary occupancy for individuals placed as part of, or in lieu of, confinement rehabilitation, or treatment in a correctional institution.
CONCRETE MIXING AND BATCHING PLANTS:
An industrial facility for the manufacturing or mixing of concrete, cement, and concrete and cement products, including any apparatus and uses incident to such manufacturing and mixing.
CONDITIONAL USE:
A use of land for which specific conditions of approval are approved by the planning commission prior to authorizing a permit therefor.
CONDOMINIUM OR TOWNHOUSE PROJECT:
A development where there is ownership of a single unit in a multiple-family development, together with an undivided interest in the common area and facilities, and such project meets all requirements of the condominium ownership act of the State of Utah.
CONDOTEL:
Any premises which operates as both a hotel and a condominium project where the units are individually owned and where owner units have the option to place their unit in the hotel's rental management program, where it is rented out like any other hotel room.
CONVENIENCE MARKETS (INCLUDING SALE OF GASOLINE):
A retail store that sells a limited line of groceries and household items intended for the convenience of the neighborhood. May also sell gasoline.
CREMATION, ANIMAL:
The technical process using direct flame and heat, aquamation, alkaline hydrolysis, or other technique to reduce animal remains to unidentifiable dimensions.
CREMATION, HUMAN:
The technical process using direct flame and heat, aquamation, alkaline hydrolysis, or other technique approved in State law to reduce human remains to unidentifiable dimensions.
CREMATION CHAMBER:
The enclosed space within the cremation process takes place.
CREMATORIUM, ANIMAL:
The building or structure that houses the cremation chamber and holding facility for animal cremation.
CREMATORIUM, HUMAN:
The building or structure that houses the cremation chamber and holding facility for human cremation.
CROP PRODUCTION, HORTICULTURE AND GARDENING:
The use of land for the growing or production for income and or personal use.
CORRECTIONAL INSTITUTION:
A prison, jail, juvenile detention facility or juvenile secure facility.
DAIRY:
A commercial establishment for manufacture or processing of dairy products.
DAIRY PRODUCT STORE:
A structure or use where dairy products are processed, packaged, and/or stored for shipment.
DANCE HALL:
A place of assembly, open to the public and operated for profit, where dances, parties, receptions, and other gatherings are held.
DELICATESSEN:
An establishment where food is sold for consumption off-premises and no counters or tables for on-premises consumption of food are provided, but excludes groceries and supermarkets.
DEPARTMENT STORE:
A business which is conducted under a single owner's name wherein a variety of unrelated merchandise and services are housed enclosed and are exhibited and sold directly to the customer for whom the goods and services are furnished.
DESIGNATED WILDERNESS, HABITAT CONSERVATION AREAS AND AREAS OF CRITICAL ENVIRONMENTAL CONCERN:
An area that is set aside for the preservation of the elements in that area.
DETACHED RESIDENTIAL UNITS:
Resident dwellings, not attached to one another, including standard single-family detached residences, zero lot line residences, cluster housing, or housing approved through density transfer.
DEVELOPMENT ACTIVITY:
A. Any construction or expansion of a building or structure;
B. Any change in use of a building or structure that creates additional demand and need for public facilities;
C. Any change in the use of land that creates additional demand and need for public facilities; or
D. Grading, filling, or clearing of land.
DEVELOPMENT AGREEMENT:
A written agreement or amendment to a written agreement between the county and one or more parties that regulates or controls the use or development of a specific area of land.
DOG KENNELS:
See Kennel.
DISABILITY:
A physical or mental impairment that substantially limits one or more of a person's major life activities, including a person having a record of such an impairment, or being regarded as having such an impairment. "Disability" does not include current illegal use of, or addiction to, any federally controlled substance, as defined in section 102 of the controlled substances act, 21 USC, or successor law.
DISTRICT:
A portion of the area of Washington County shown on a map attached to the zoning ordinance and given a district name.
DOMESTIC ANIMALS:
A.   Animals historically found on farms in Washington County. "Domestic animals" shall not include animals commonly found in zoos and animal preserves and which animals are not historically endemic to the Washington County area.
B.   Exception: Llamas may be considered as domestic animals, subject to the number limitations of the residential estate zone.
DRUGSTORE:
An establishment engaged in the retail sale of prescription drugs, nonprescription medicines, cosmetics, and related supplies.
DRY CLEANING:
A building, portion of a building, or premises used or intended to be used for cleaning fabrics, textiles, wearing apparel, or articles of any sort by immersion and agitation, or by immersions only, in volatile solvents including, but not by way of limitation, solvents of the petroleum distillate type, and / or the chlorinated hydrocarbon type, and the processes incidental thereto.
DWELLING:
Any building or portion thereof containing one dwelling unit occupied, designed or intended as a residence for one family, excluding timeshare, or short-term residential rental use.
DWELLING, CARETAKER, INCIDENTAL TO AGRICULTURE USE:
Accessory dwelling on an agriculture lot or parcel, occupied by an employee of the lot or parcel owner who has responsibilities related to the agriculture operation of the property, and counted as an ADU.
DWELLING, GROUP:
Two (2) or more dwellings located in more than one building placed upon a single lot.
DWELLING, MULTIPLE-FAMILY:
A building arranged or designed to be separately occupied as more than two (2) dwelling units.
DWELLING, PRIMARY:
A single family dwelling occupied as the primary residence of the owner of record.
DWELLING, RENTAL:
A building or portion of a building that is used as a residential dwelling by one or more persons, and available due to payment or remuneration to be rented, loaned, leased, or hired out for a period of thirty (30) days or longer.
DWELLING, SEASONAL:
A dwelling used for recreational or leisure purposes with the occupancy period for such dwelling limited to a maximum of one hundred eighty (180) days, or less, for each calendar year.
DWELLING, SINGLE-FAMILY:
A building arranged or designed as a single dwelling unit, excluding timeshare or short term residential rental use.
DWELLING SITE:
The lot upon which a dwelling has been constructed and inhabited.
DWELLING, TWO-FAMILY:
A building arranged or designed as two (2) dwelling units.
DWELLING UNIT:
Any building or portion thereof designed, occupied, or intended to have a residential use with sleeping, bathroom and kitchen facilities for the exclusive use of one (1) family.
DWELLING UNIT, ACCESSORY (ADU):
A subordinate residential living area with sleeping, bathroom and kitchen facilities created within a single family dwelling, or a detached building on the same residential lot or parcel as the single family dwelling, which meets the requirements of 10-13-18, not used for short term rental absent a Short Term Rental License. This term includes, but is not limited to, a casita, guesthouse or mother-in-law apartment/suite.
DWELLING UNIT, INTERNAL ACCESSORY (INTERNAL ADU):
An accessory dwelling unit created within a primary dwelling inside the footprint of the primary dwelling.
EDUCATION INSTITUTIONS:
Any public, parochial, private, charitable, or nonprofit preschool, childcare, primary-elementary schools, secondary-high schools, junior college, or university, other than trade or business schools, including instructional and recreation uses, with or without living quarters, dining rooms, restaurants, heating plants, and other incidental facilities for students, teachers and employees.
EGG AND POULTRY STORE (RETAIL SALES ONLY), PROVIDED NO LIVE BIRD SLAUGHTERING PERMITTED:
An establishment for the purpose of retail sells of eggs and poultry.
ELDERLY PERSON:
A person who is sixty (60) years or older, who desires or needs to live with other elderly persons in a group setting, but who is capable of living independently.
ELECTRICAL AND HEATING APPLIANCES AND FIXTURES SALES AND SERVICES:
An establishment that sells and repairs electrical and heating appliances and fixtures for profit.
ELECTRICAL SHOPS:
An establishment that sells electrical equipment and supplies.
EMPLOYMENT AGENCY:
An establishment that finds employers or employees for those seeking them.
EXOTIC ANIMALS:
Animals not historically found on farms in Washington County. "Exotic animals" shall include animals commonly found in zoos and animal preserves and which animals are not historically endemic to the Washington County area.
FAMILY:
One or more persons related by blood, marriage, adoption or guardianship, or a group of not more than five (5) unrelated persons living together as a single nonprofit housekeeping unit, together with staff person who resides on the premises. "Family" does not exclude the care of foster children. "Family" includes two (2) unrelated persons and any children related to either of them living together as a single housekeeping unit.
FARM AND CONSTRUCTION EQUIPMENT SALES, RENTAL AND SERVICE:
An establishment that is for selling, trading, repairing, or renting of farm and construction equipment.
FARM BUILDINGS AND USES:
Any building used for storing agricultural equipment or farm produce or products, housing livestock or poultry, or processing dairy products.
FARM IMPLEMENT SALES:
A structure used for the maintenance, repair, or fabrication of farm equipment by the owner or operator of the farm.
FARMING OPERATIONS:
The raising and production of primary agricultural products.
FEED, CEREAL OR FLOUR MILL:
An establishment that is for the purpose of grinding feed, cereal or flour, and housing such equipment and tools.
FENCE (SOLID):
A fence of a material that is sight obscuring and made of a solid material such as wood, vinyl or masonry, but not including a chainlink fence with slats inserted into the chainlinks. Any questionable material shall be reviewed by the planning commission for determination.
FENCED RV STORAGE AREAS:
An area that is for storing RVs that is marked off by fences.
FENCE, SALES AND SERVICE:
An area that buys, sells, and performs other fence services.
FERTILIZER AND SOIL CONDITIONER:
An establishment that manufactures, sells, trade, and anything like unto it, fertilizer and soils conditioner.
FINE ARTS OR PERFORMING ARTS STUDIO OR SCHOOL:
A school where classes in the various arts (e.g. dance, painting, sculpting, singing) are taught to four or more persons at a time.
FISHING:
The activity of catching fish, either for food or as a sport.
FISH FARMS:
An area of land complete with an artificial pond or ponds in which fish are reared and sold to consumers.
FLOODPLAINS:
The land area susceptible to inundation by water as a result of the flood.
FOUNDRY, LIGHTWEIGHT CASTING, NONFERROUS WITHOUT NOXIOUS ODORS OR FUMES:
A workshop or factory for casting metal.
FRATERNAL ORGANIZATIONS:
A group of people formally organized for a common interest, usually cultural, religious, or entertainment, with regular meetings and formal written membership requirements.
FRUIT STORE (ENCLOSED):
A shop that sells a variety of edible fruits.
FUNERAL HOME:
A building used for the preparation of the deceased for burial and display of the deceased and rituals connected therewith before burial or cremation.
FUR FARMS:
A facility where fur-bearing animals are kept, raised, or bred.
FURNITURE UPHOLSTERY SHOP:
An establishment that provides furniture with padding, springs, webbing, fabric or leather covers, and things like unto it.
GARAGE, PUBLIC:
A building or portion thereof, other than a private garage, designed or used for servicing, repairing, equipping, hiring, selling or storing motor driven vehicles.
GARDEN SUPPLIES AND PLANT MATERIAL SALES:
An establishment that sells garden and plant supplies and accessories at retail.
GIFT STORE:
Retail stores where items such as art, antiques, jewelry books, and notions are sold.
GOLF COURSE:
A tract of land laid out with at least nine (9) holes for playing a game of golf and improved with tees, greens, fairways, and hazards. A golf course may include a clubhouse, restrooms, driving range, and shelters as accessory uses.
GOVERNMENT BUILDINGS OR USES:
A building that houses a branch of government.
GRADE:
The lowest point of elevation of the finished surface of the ground, paving or sidewalk within the area between the building and the property line or, when the property line is more than five feet (5') from the building, between the building and a line five feet (5') from the building.
GRAVEL CRUSHING EQUIPMENT:
Equipment that is used in the process of crushing gravel.
GRAVEL PITS/ QUARRY:
An open pit from which building stone, sand, gravel, aggregates, mineral, or fill is removed. Site may include crushing or processing equipment.
GREENHOUSES:
An establishment where flowers, shrubbery, vegetables, trees, and other horticultural and floricultural products are grown both in open and enclosed buildings.
GROCERY STORE:
A retail establishment primarily selling prepackaged and perishable food as well as other convenience and household goods.
GROUP HOMES:
An establishment that provides room and board, personal care, habilitation services, and supervision in a family setting for developmentally disabled persons.
GUNSMITH:
A person who makes, sells, and repairs small firearms.
HARDWARE STORES:
A facility where primarily engaged in the retail sale of various basic hardware lines, such as tools, builders' hardware, plumbing and electrical supplies, paint and glass, housewares and household appliances, garden supplies, and cutlery.
HEALTH CLUB:
A place or building where passive or active exercises and related activities are performed for the purpose of physical fitness, improved circulation or flexibility, and / or weight control.
HOME GARDENS AND FRUIT TREES:
A parcel used for the growing of vegetables, flowers, fruit, etc. used for human consumption and enjoyment but not commercial use.
HOME OCCUPATION:
A business, profession, occupation, or trade conducted for gain or support and located on residentially zoned property where the principal owner of the business resides. The home occupation must be accessory, incidental, and secondary to the use of the residence for dwelling purposes and not change the essential residential character or appearance of the property or the neighborhood. Agricultural businesses are not home occupations. Youth enterprises are not home occupations. Home occupations are subject to the requirements set forth in chapter 26 of this title. There are two (2) classifications of home occupations.
A.   Minor Home Occupation:
   1. A minor home occupation is:
      a. Low impact in nature in that it does not introduce noise, fumes, dust, lighting, or traffic above what is customary for the neighborhood;
      b. Performed by the property owner or family of the property owner (e.g., children, parents, siblings, grandchildren, grandparents, nieces, nephews, aunts, or uncles) (except that offsite employees are permitted for daycares and preschools); and
      c. Meets the criteria outlined in section 10-26-1 of this title.
   2. As long as the above requirements are met, the following are examples of minor home occupations:
      a. Appliance repair;
      b. Artists and sculptors;
      c. Authors and composers;
      d. Crafts for sale off site;
      e. Dance lessons with no more than eight (8) students at a time;
      f. Daycares with no more than eight (8) children at a time;
      g. Electronic repair;
      h. Gun repair;
      i. Individual tutoring;
      j. Instrument lessons;
      k. Massage therapy;
      l. Office facilities of a sales representative, or manufacturer's representative;
      m. Selling of items primarily through parties held in private residences;
      n. Phone or internet sales;
      o. Photo studios;
      p. Preschools with no more than eight (8) students at a time;
      q. Professional office;
      r. Sewing;
      s. Single chair beauty parlors and barbershops;
      t. Small engine repair;
      u. Swim lessons with no more than eight (8) students at a time;
      v. Tax preparation;
      w. Upholstering; and
      x. Woodworking.
B. Major Home Occupation:
   1. A major home occupation is:
      a. A use that may introduce minimal increases in noise, fumes, dust, lighting, and traffic into the neighborhood but allows the residential character of the neighborhood to be maintained;
      b. Performed by the homeowner, the family of the homeowner (e.g., children, parents, siblings, grandchildren, grandparents, nieces, nephews, aunts, or uncles), and:
         1) Generally, up to one other employee on the property at a time; however,
         2) If the nature of the home occupation does not bring clientele to the premises, then up to three other employees may be on the property at a time; additionally,
         3) There is no limit on the number of employees permitted for daycares and preschools; and
      c. Meets the criteria in section 10-26-2 of this title.
   2. As long as the above requirements are met, the following are examples of major home occupations:
      a. Auto detailing;
      b. Auto repair on a lot or parcel, but not if it is in a recorded subdivision;
      c. Carpet or upholstery cleaning;
      d. Contractors;
      e. Dance lessons with more than eight (8) but less than twelve (12) students at a time;
      f. Daycares with more than eight (8) but less than twelve (12) children at a time;
      g. Game meat processing;
      h. Lawn and yard care;
      i. Multiple chair beauty parlors and barbershops;
      j. Pest and weed control services;
      k. Preschools with more than eight (8) but less than twelve (12) students at a time (excluding children that live on the property);
      l. Swim lessons with more than eight (8) students at a time but less than twelve (12) at a time (excluding children that live on the property); and
      m. Taxidermy.
HONEY EXTRACTION AND PROCESSING:
The process of removing honey from honeycomb to then make it ready to be sold or traded.
HORTICULTURE AND GARDENING FOR PERSONAL USE:
See home gardens and fruit trees.
HOSPITAL:
An institution licensed by the State of Utah which provides diagnostic, therapeutic and rehabilitative services to individuals on both an inpatient and outpatient basis by or under the supervision of one or more physicians. Any medical clinic or professional office which offers any inpatient or overnight care, or operates on a twenty four (24) hour basis shall be considered to be a "hospital". A "hospital" may include integral support services facilities such as laboratories, outpatient units and training and central services, together with staff offices necessary to the operation of the hospital.
HOT MIX ASPHALT PLANTS:
A plant that is used for the manufacturing of asphalt.
HOTEL:
Any building containing rooms which are used, rented, or hired for sleeping purposes by transient guests and with access to units primarily from interior lobbies, courts, or halls.
HOUSEHOLD APPLIANCE SALES AND SERVICE:
An establishment that sells and services household appliances and accessories.
HOUSEHOLD PETS:
Animals or fowl ordinarily permitted in the house and kept for personal use, such as dogs and cats, but not kept for commercial purposes, as defined in this title, and not exceeding five in total number if in a zone where the lot size is one acre or less.
HUNTING:
The activity of hunting wild animals or game, especially for food or sport.
ICE CREAM PARLOR:
Establishment whose primary business is the sale of ice cream.
ICE MANUFACTURE AND STORAGE:
An establishment where ice is made on a large scale and is stored on the premises.
ICE STORE OR VENDING STATION:
An establishment where ice is brought in from a different location and sold or given to the public in some way.
INDEPENDENT LIVING CARE FACILITIES:
A care facility where the residents have the majority control of their schedules, needs, and things of that nature.
INDOOR ENTERTAINMENT:
An establishment providing entertainment or recreational activities within an enclosed building. Such as: bounce house, climbing gym, live theater, movie theater, dance company, bowling and similar uses.
INSTITUTION OF HIGHER EDUCATION (COLLEGE):
A post-secondary institution for higher learning that grants associates or bachelor degrees and may also have research facilities and / or professional schools that grant master and doctoral degrees. This may also include community colleges that grant associates or bachelor degrees or certificates of completion in business or technical fields.
INSULATION SALES AND SERVICE:
A development that provides supplies, tools and other services for insulation purposes.
INSURANCE AGENCY:
A group of people that sells a variety of insurance and financial products.
INTERIOR DECORATING AND DESIGNING ESTABLISHMENT:
An establishment from where professional home interior decorating services are provided.
JAIL:
A place of incarceration owned and operated by the county.
JANITOR SERVICE AND SUPPLY:
An establishment where cleaning supplies, equipment and other janitorial necessities are able to be purchased and janitorial services are provided.
JEWELRY STORE SALES AND SERVICE:
Shops that sell new merchandise primarily and some used merchandise from estate sales or reconstitute precious metals they purchase into jewelry forms that are sold at retail on the premises. Cleanings, repairing, and any other like service towards jewelry may be done as well.
JUNK:
Any or all worn out, cast off, destroyed or discarded article or material which is ready for destruction or has been collected and stored for salvage or conversion to some other use. Any article or material which, unaltered, unchanged and without further recondition, can be used for its original purpose as readily as when new and shall not be considered “junk”. Additionally, in a recorded subdivision, for residential zones five acres or less minimum lot size, junk includes weeds that have accumulated in number, or to a height, that pose a safety, fire or health risk to the lot at issue or adjacent properties, including dead and dying vegetation or other combustible material.
JUNK CARS:
Any used car or motor vehicle which has been abandoned for use as a motor vehicle on a public highway, or which is not registered, or which is in an unsafe operating condition and shall have remained in such condition for a period in excess of thirty (30) days; or portions of junk cars, such as hoods, fenders, radiators, rims, motors, hubcaps, etc., not being immediately utilized in the repair of a motor vehicle. Exception: The items de-scribed in this definition, as listed above, may be stored in a completely enclosed building, or in an area behind a minimum six-foot high, solid fence (chain-link fencing with slats is not considered a solid fence for purposes of this section).
JUNKYARD:
Any place, establishment or business maintained, used or operated for storing, keeping, buying or selling junk, or for the maintenance or operation of an automobile graveyard, and includes garbage and sanitary fills.
JUVENILE DETENTION FACILITY:
A place of temporary detention for delinquent juveniles, which either is owned and operated by the State of Utah or is under contract with the State of Utah.
JUVENILE SECURE FACILITY:
A place of incarceration for delinquent juveniles, which either is owned and operated by the state of Utah or is under contract with the state of Utah.
KENNEL:
An establishment having three (3) or more dogs for the purpose of boarding, breeding, buying, grooming, letting for hire, training for fee, adopting or selling.
KITCHEN:
Any room or portion of a room designed, used, or intended to be used for cooking or preparation of food. A kitchen may consist of a stove (gas or electric) and at least one of the following: refrigerator of any size, sink, dishwasher, pantry, or cabinets.
LABORATORY, DENTAL OR MEDICAL:
A building or group of buildings in which are located facilities for medical or dental purposes.
LANDFILL OPERATIONS:
A lot or part thereof used primarily for the disposal by abandonment, dumping, burial, burning, or other means and for whatever purpose, or garbage, sewage, trash, refuse, junk, discarded machinery, vehicles or parts thereof, or nontoxic waste material of any kind.
LAUNDRY OR DRY CLEANERS, LAUNDROMAT:
A facility where patrons wash, dry, or dry clean clothing or other fabrics in machines operated by the patron.
LEGAL OFFICES:
A building or set of buildings used for legal purposes.
LIBRARY, PUBLIC:
A public facility for the use, but not sale, of literary, musical, artistic, or reference materials.
LIQUOR STORE:
A facility for the sale of package liquor which is located on premises owned or leased by the State and operated by State employees. (This definition shall not be construed to include package agencies accessing to another main use, or to restaurants with the proper permits.)
LIVESTOCK:
Means cattle, sheep, goats, swine, horses, mules, poultry, or any other domestic animal or domestic furbearer raised or kept for profit.
LIVESTOCK FEED PROCESSING AND STORAGE:
An establishment where feed for livestock is processed and stored.
LIVESTOCK FEED YARD:
A commercial operation on a parcel of land where livestock are kept in corrals or yards for extended periods of time at a density which permits little movement, and where all feed is provided for the purpose of fattening or maintaining the condition of livestock prior to their shipment to a stockyard for sale, etc.
LIVESTOCK GRAZING:
Land that is for the purpose of cattle, sheep, etc., to feed on growing grass and pasturage.
LOCSKSMITH:
A person who makes and repairs locks.
LODGES AND DUDE RANCHES:
An establishment that is primarily for vacation resorts for tourists.
LODGES, PRIVATE:
An establishment that regularly hold meetings for members of an organization.
LODGING, COMMERCIAL:
An establishment that provides lodging, meals, and other guest services.
LOT:
A parcel of land occupied or to be occupied by a main building, or group of buildings (main and accessory), together with such yards, open spaces, lot width and lot area as are required by this title, and having frontage upon a dedicated and improved county road. Except for multiple-family dwellings, not more than one dwelling structure shall occupy any one lot.
LOT, CORNER:
A lot having frontage on two (2) or more improved and dedicated county roads.
LOT LINE ADJUSTMENT:
A relocation of a lot line boundary between adjoining lots or between a lot and adjoining parcel(s), whether or not the lots are located in the same subdivision, and in accordance Utah Code Ann. 17-27a-608. A lot line adjustment does not mean a new boundary line that creates an additional lot or results in the subdivision of any lot.
LOUNGE:
A commercial enterprise whose primary activity is the sale of alcoholic beverages to be consumed on the premises.
LUMBERYARD:
A facility where building materials such as lumber, plywood, drywall, paneling, cement blocks and other cement products, and other building products are stored and sold. Lumberyards may also process lumber by performing millwork, planning, cutting, and other customizing processes. Lumberyards may provide for the sale of associated products including tools and fasteners.
MACHINE SHOP GENERAL:
Shops where lathes, presses, grinders, shapers, and other wood-and metal-working machines are used such as blacksmith, tinsmith, welding, and sheet metal shops; plumbing heating, and electrical repair shops; and overhaul shops.
MANAGING AGENCY OR AGENT:
A local person, firm or agency representing an owner-occupant of a dwelling with a Short Term Rental License. The responsible party must be available by telephone twenty four (24) hours per day for contact by renter, emergency services and applicable Washington County representatives.
MANUFACTURED HOME:
A transportable factory built housing unit constructed on or after June 15, 1976, according to the federal home construction and safety standards act of 1974 (HUD code) in one or more sections, which, in the traveling mode, is eight (8) body feet or more in width or forty (40) body feet or more in length, or when erected on site, is four hundred (400) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning and electrical systems.
MANUFACTURED HOME PARK:
Any area or tract of land used or designed to accommodate two (2) or more manufactured homes for permanent living purposes as opposed to a recreational vehicle park where campers or travel trailers are parked for overnight or short periods of time.
MANUFACTURED HOME SALES LOT AND SERVICES:
An establishment primarily for the selling of manufactured homes and repair services.
MANUFACTURING ESTABLISHMENTS:
An establishment primarily used for the mechanical or chemical transformation of materials or substances into new products, including the assembling of component parts, the creation of products, and the blending of materials including but not limited to oils, plastics, resins, etc.
MINING AND MINERAL DEVELOPMENT:
All or any part of the process involved in the mining of minerals.
MINING OR ORE PROCESSING OPERATIONS:
All or any part of the process involved in the mining of minerals or ore.
MOBILE FOOD BUSINESS:
A business that serves food or beverages from a self-contained unit either motorized or in a trailer on wheels, and conducts all or part of its operations on premises other than its own and is readily movable, without disassembling for transport to another location.
MOBILE FOOD COURT:
A parcel of land where two (2) or more mobile food business-related to offer food or beverages for sale to the public. Any cluster of more than one mobile food business located on the same parcel of land shall be considered a mobile food court. The mobile food court may include permanent structures such as restrooms, pavilion or eating area with seating and tables.
MOBILE HOME:
A transportable factory built housing unit built prior to June 15, 1976, in accordance with the state mobile home code which existed prior to the federal manufactured housing and standards act (HUD code).
MOBILE HOME PARK:
A parcel of land, approved prior to May 27, 1997, which was planned and improved for the placement of mobile homes for residential use.
MORTUARY:
An establishment in which the deceased are prepared for burial or cremation. The facility may include a chapel for the conduct of funeral services and spaces for funeral services and informal gatherings or display of funeral equipment.
MOTEL:
Any building or group of buildings containing sleeping rooms, designed for temporary use by automobile tourists or transients, with garage attached or parking space conveniently located to each unit.
MUSEUM:
A room or building for exhibiting, or an institution in charge of, a collection of books, or artistic, historical, or scientific objects.
NATIONAL FORESTS:
A large expanse of forest that is owned, maintained, and preserved by the federal government.
NATIONAL PARKS AND MONUMENTS:
A scenic or historically important area of countryside protected by the federal government for the enjoyment of the general public or the preservation of wildlife.
NATURAL WATERWAYS:
Those areas, varying in width, along streams, creeks, springs, gullies or washes which are natural drainage channels as determined by the building inspector, in which areas no buildings shall be constructed.
NONCONFORMING BUILDING OR STRUCTURE:
A building or structure or portion thereof, lawfully existing on the effective date hereof, which does not conform to all regulations herein prescribed in the zone in which it is located.
NONCONFORMING USE:
A use which lawfully occupied a building or land on the effective date hereof and which does not conform with the use regulations of the zone in which it is located.
NURSERY:
Any land used to raise trees, shrubs, flowers, and other plants for sale or for trans-planting.
NURSING HOME:
An institution providing residence and care for the aged or infirm.
OFFICE, DENTAL:
A building used for dental personal for the treatment and examination of patients solely on an outpatient basis, provided that no overnight patients shall be kept on the premises.
OFFICE, MEDICAL:
A building used for medical personal for the treatment and examination of patients solely on an outpatient basis, provided that no overnight patients shall be kept on the premises.
OFFICE, PROFESSIONAL, PRIVATE:
Office rooms that are separated from the open areas.
OFFICE, PROFESSIONAL, PUBLIC:
Offices that are open to the public.
OFFICE SUPPLY, OFFICE MACHINES SALES AND SERVICE:
An establishment that primarily sells office supplies, machines and perform things like it.
OPEN SPACE AGRICULTURAL USES:
Open space that is used for agricultural purposes.
OPTOMETRIST, OPTICIAN OR OCULIST:
A person qualified to make and supply eyeglasses and contact lenses for correction of vision.
PARK MODEL RECREATIONAL VEHICLE (PMRV):
A transportable enclosed structure built on a single chassis, mounted on axle(s) and wheels; generally designed and constructed as temporary human occupancy housing accommodation for recreation, camping or seasonal use. They do not meet HUD standards for construction and manufacturing. A "tiny home", or stick built structure on a single chassis, mounted on axle(s) and wheels is considered a PMRV. A PMRV is not permitted as an accessory dwelling. They may be approved in the manufactured housing park and recreational vehicle park zone (MH); or as a conditional use permit for campgrounds and in approved rural recreation grounds and facilities.
PARKING LOT:
An open area other than a street, used for parking.
PARK OR PLAYGROUNDS:
An open space with natural vegetation and landscaping; may include recreational facilities.
PARKING SPACE:
Space within a building, lot or parking lot for the parking or storage of one automobile.
PAVILION:
An open sided structure with the roof supported by posts, columns or pillars. Used as shelter for picnics, or small gatherings. A pavilion is not a carport and may not be used for vehicle storage or shelter. A pavilion is an accessory building. A pavilion may be conditionally approved to be constructed prior to construction of a primary dwelling on a parcel located in the OST-20 (Open Space Transition), OSC-20 (Open Space Conservation), A-20 (Agricultural), SFR (Seasonal Forest Residential) and FR (Forest Residential) zones.
PAWNSHOP:
An establishment that engages, in whole or in part, in the business of loaning money on the security of pledges of personal property, or deposits or conditional sales of personal property, or the purchase or sale of personal property.
PEST CONTROL AND EXTERMINATION:
The regulation or management of ridding pests from a location.
PET AND PET SUPPLY STORE:
A retail establishment primarily involved in the sale of domestic animals, such as, but are not limited to, dogs, cats, fish, birds, and reptiles. Supplies for these animals may also be sold on the premises.
PHARMACY:
A place where drugs and medicines are prepared and dispensed.
PHYSICIAN OR SURGEON OFFICE CLINIC:
A building used for physician or surgeon's services.
PLANNED DEVELOPMENT (PD):
A development in which the regulations of the zone in which the development is situated are modified to allow flexibility and initiative in site and building design and location in accordance with an approved plan.
PLANNED RECREATIONAL EVENTS:
Recreational events that have been planned and have received the proper permits.
PLANING MILL:
A facility that takes cut and seasoned boards from a sawmill and turns them into finished dimensional lumber.
POOL HALL:
An establishment that provide billiard or pool tables for customer's use.
POST OFFICE:
A facility that contains service windows for mailing packages and letters, post office boxes, offices, vehicle storage areas, and sorting and distribution facilities for mail.
POULTRY COOPS:
A cage or pen for confining poultry.
POULTRY KILLING AND DRESSING:
The killing and dressing of poultry and the means to dispose of waste.
POULTRY RAISING:
Using land or a portion of land for the purpose of raising poultry.
PRINTING:
The production of books, newspapers, or other printed material.
PROTECTIVE HOUSING FACILITY:
A facility either:
A. Operated, licensed or contracted by a governmental entity; or
B. Operated by a charitable, nonprofit organization, where, for no compensation, temporary, protected housing is provided to:
1.   Abused or neglected children awaiting placement in foster care;
2.   Pregnant or parenting teens;
3.   Victims of sexual abuse; or
4.   Victims of domestic abuse.
PRINTING, LITHOGRAPHING, PUBLISHING OR REPRODUCTION SALES AND SERVICE:
A facility for the custom reproduction of written or graphic materials on a custom order basis for individuals or businesses.
PROFESSIONAL OFFICE:
Offices used by someone trained and engaged in such work for a career.
PUBLIC FACILITIES:
Including fire protection, police protection, public works facilities, public libraries, public parks or other public facility development.
PUBLIC HEALTH FACILITIES:
Facilities that provide health services for the public.
PUBLIC UTILITIES:
An organization supplying a community with electricity, gas, water, or sewerage.
PUBLISHING OR LITHOGRAPHY SHOPS:
See printing, lithographing, publishing or reproduction sales and service.
QUARRY:
See Gravel Pits/Quarry.
RAISING OF CROPS, HORTICULTURE AND GARDENING:
Using land or a portion of land for the purpose of raising crops, horticulture and/or gardening.
REAL ESTATE AGENCY:
An establishment that acts as an intermediary between sellers and buyers of property.
RECEPTION CENTER OR WEDDING CHAPEL:
A building or room, other than a legal court, where marriages are regularly performed and/or where other gatherings may be held.
RECREATION CENTER:
A place primarily used for recreational purposes.
RECREATION, COMMERCIAL OUTDOOR:
Any business, group or individual that receives monetary gain for providing specialized equipment, guided tours, access to private land, and outdoor activities and adventures including, but not limited to, boating, fishing, canoeing, rafting, climbing, canyoneering, horse rides, ATV riding, mountain biking and four-wheeling, but not including campgrounds or any other activity with overnight stay, structures, or dwellings.
RECREATIONAL VEHICLE (RV):
A vehicle, regardless of size, which is not designed to be used as a permanent dwelling, and in which the plumbing, heating and electrical systems contained therein may be operated without connection to outside utilities and which are self-propelled or towed by a light duty vehicle. Designed for recreational use, camping or temporary occupancy.
RECREATIONAL VEHICLE PARK:
Any lot or parcel of land used or intended to be used for the accommodation of two or more recreational vehicles for transient dwelling purposes. A Recreational Vehicle Park may only be approved as a conditional use in the MH (Manufactured Housing Park and Recreational Vehicle Park) zone and must meet the applicable requirements of Washington County Code chapter 10-8G.
RECYCLING BUSINESSES, NOT INCLUDING HAZARDOUS MATERIALS:
An establishment primarily used for recycling purposes.
REHABILITATION/
TREATMENT FACILITY:
A facility licensed by or contracted by the State of Utah to provide temporary occupancy and supervision of individuals (adults/juveniles) in order to provide rehabilitation, treatment or counseling services. Without limitation, such services may include rehabilitation, treatment, counseling or assessment and evaluation services related to delinquent behavior, alcohol and drug abuse, sex offenders, sexual abuse or mental health. Associated educational services may also be provided to juvenile occupants.
RECREATIONAL VEHICLES: PERMITTED MAY 15 THROUGH NOVEMBER 15:
A vehicular unit, other than a mobile home, primarily designed as a temporary dwelling for travel, recreational or vacation use, which is either self-propelled or pulled by another vehicle. Recreational vehicle includes a travel trailer, a camping trailer, a motor home, a fifth wheel trailer and a van.
RENTAL AGENCY FOR HOME AND GARDEN EQUIPMENT:
An establishment that rents home and garden equipment.
RETAIL GENERAL:
Commercial space used for the sale of commodities and consumer goods such as; clothing, electronics, hardware, food and furniture to the consumer.
RESIDENCE, RESIDENTIAL FACILITY:
Any building or portion thereof where an individual is actually living at a given point in time and intends to remain, and not a place of temporary sojourn or transient visit.
RESIDENTIAL CHARACTER:
The characteristics of a neighborhood that make it residential, i.e., having the feel of being a neighborhood, as opposed to an area that has a commercial, industrial, or manufacturing feel. These characteristics include, but are not limited to, the intent of the zone, with careful consideration being given to the permitted and conditional uses allowed within the zone; the population density of the surrounding area; safety, with particular weight being given to the safety of children residing nearby; peace-fulness that is consistent with a residential area; whether the home occupation is one generally conducted within a residential neighborhood; low traffic density; and any other factor that may impact the quality of life that is customary within the neighborhood.
RESIDENTIAL FACILITY FOR ELDERLY PERSONS:
A.   A dwelling unit that is either owned by one of the residents or by an immediate family member of one of the residents, or is a facility for which the title has been placed in trust for a resident; and is occupied on a twenty four (24) hour per day basis by eight (8) or fewer elderly persons in a family type arrangement.
B.   A "residential facility for elderly persons" shall not include any facility:
1. Which is operated as a business; provided, that such facility may not be considered to be operated as a business solely because a fee is charged for food or for actual and necessary costs of operation and maintenance of the facility;
2. Where persons being treated for alcoholism or drug abuse are placed;
3. Where placement is not on a strictly voluntary basis or where placement is part of, or in lieu of, confinement, rehabilitation, or treatment in a correctional institution;
4. Which is a healthcare facility as defined in Utah Code Annotated section 26-21-2; or
5. Which is a residential facility for persons with a disability.
RESIDENTIAL FACILITY FOR PERSONS WITH A DISABILITY:
A residence in which more than one person with a disability resides and which is:
A.   Licensed or certified by the department of human services under Utah Code Annotated title 62A, Chapter 2, licensure of programs and facilities; or
B.   Licensed or certified by the department of health under Utah Code Annotated title 26, Chapter 21, healthcare facility.
RESIDENTIAL FACILITY FOR PERSONS WITH A DISABILITY, SEASONAL:
A seasonal residence in which more than one person with a disability resides and which is:
A.   Licensed or certified by the department of human services under Utah Code Annotated Title 62A, Chapter 2, licensure of programs and facilities; or
B.   Licensed or certified by the department of health under Utah Code Annotated Title 26, Chapter 21, healthcare facility.
RESIDENTIAL USE:
Customarily includes overnight use of a room or rooms with independent facilities for sleeping combined with a private bath and/or a kitchen.
RESTAURANT:
An establishment where food and beverages are prepared, served, and consumed primarily within the principal building.
RESTAURANT, DRIVE-IN:
An establishment whose primary business is serving food to the public for consumption on the premises by order from and service to vehicular passengers outside the structure.
RIDING STABLES AND TRAINING AREA:
An establishment that is use for the keeping, training and riding of horses.
RIDING STABLES, PUBLIC:
A riding stable that is open to the public.
ROLLER SKATING RINK:
An establishment that is for the purpose of roller skating or things like unto it.
RUBBER WELDING:
The act of welding rubber.
SANDBLASTING:
Roughing or clean a surface with a jet of sand driven by compressed air or steam.
SECONDHAND STORE:
Retail sales of previously used merchandise, such as clothing, household furnishing or appliances, sports/recreational equipment. This classification does not include secondhand motor vehicles, parts, or accessories.
SEED AND FEED STORE RETAIL:
An establishment that sells seed and feed for retail.
SEXUALLY ORIENTED BUSINESSES:
An inclusive term used to describe collectively those businesses for which a sexually oriented business license is required, pursuant to the sexually oriented business license chapter set forth in Title 3, Chapter 4 of this code, which types of businesses include, for purposes of this title, adult arcade, adult bookstore, adult novelty store, adult video store, adult cabaret, adult motel, adult motion picture theater, adult theater, escort, escort agency, massage parlor, seminude modeling studio, sexual encounter establishment, and any other business not described that has a dominant or principal theme that is sexually oriented.
SHEET METAL:
Metal formed into thin sheets, typically by rolling or hammering.
SHOOTING RANGE/ TACTICAL TRAINING FACILITY, OUTDOOR:
An outdoor area and facility designated, utilized and operated for the purpose of firearm and tactical training, including target shooting, shooting events. Facility operated by a club, corporation, association, government entity or other legal entity. Facility must meet the industry standards and practices including health, safety, noise, and dust.
SHOP, SOUVENIR:
An establishment that primarily sells souvenirs relating to a particular topic or theme.
SHORT-TERM RENTAL (STR):
Property that is occupied, possessed or used by any person or entity for transient lodging where the term of occupancy, possession, or use is offered for twenty-nine (29) consecutive calendar days or less, for direct or indirect compensation or other consideration.
SIGN MANUFACTURE:
An establishment that is for the manufacturing of signs.
SHIPPING CONTAINER: "CONEX BOX", "CARGO CONTAINER", "INTERMODAL SHIPPING CONTAINER":
A standardized reusable fully enclosed unit often constructed of corrugated steel, usually rectangle in shape manufactured for the purpose of intermodal transporting goods and materials by rail, road, air or sea. The following shall apply to shipping containers:
1.   Shipping containers that have transported goods to a site may be used for the temporary storage of such transported goods as an accessory use to a legally established primary use in the M1 (Manufacturing) zone, I-1 (Industrial) zone and C-1, C-2, C-3, PDC (Commercial) zones subject to the following conditions:
A. The location of the temporary storage area shall be noted on the site plan establishing the primary use of site. If there is not a site plan for an existing use, then a site plan shall be submitted for approval as outlined in each of the applicable zones.
B. The temporary storage area shall be screened from view from any public right of way and residential development.
C. Shipping containers shall not be stacked.
D. Shipping containers shall not be converted into permanent structures or use for permanent storage without first receiving conditional use approval and a building permit.
2.   Shipping containers used for storage in OST-20, OSC-20, Agricultural and all Residential zones.
A. Shipping containers shall not be stacked.
B. Shipping containers are an accessory building and must comply with the applicable setbacks and all other requirements of this ordinance and applicable county and building code for an accessory building.
C. The temporary storage area shall be screened from view from any public right of way.
D. The exterior of the shipping container shall be maintained and structurally intact.
E. No more than one (1) shipping container shall be allowed on a residential lot one (1) acre in size or less. Two (2) shipping containers shall be allowed on residential lots greater than one (1) acre in size and up to five (5) acres in size. Residential lots five (5) acres in size or larger shall not have more than five (5) shipping containers.
3.   Shipping containers used for storage during construction.
A. Shipping containers may be used in all land use zones for temporary storage of construction related materials on a building site for which an active building permit or excavation permit.
B. Shipping containers must be removed within fourteen (14) days upon final inspection of permit, or comply with the accessory building requirements of this and all other applicable county and building codes.
4.   The storage of hazardous material is prohibited.
5.   Modification of shipping containers to create a residential dwelling or commercial structure is permitted subject to all applicable county land use code and adopted building codes.
6.   Modified shipping containers may be approved as a temporary structure or enclosure in a PD (Planned Development) project.
7.   Shipping containers shall be painted one, solid, muted color that blends with the surrounding vegetation, natural topography or structures.
8.   Shipping containers shall not display advertising, company logos, names or other markings painted on, or otherwise attached to the exterior of the shipping container.
9.   The use of box truck cargo container, van body, semi-truck trailer, bus body, camper or RV are not permitted as an accessory structure, shed or storage.
10.   Shipping containers established as a temporary structure prior to the adoption of this code are not exempt from the screening requirement.
11.   Shipping containers may not be used as the base to a truss based roofing structure.
SIGN PAINTING:
An establishment that primarily paints signs and stores such equipment.
SILO (VERTICAL OR HORIZONTAL):
A tower or pit on a farm used to store grain. A silo may exceed the maximum building height requirement in the agricultural zones.
SITE DEVELOPMENT STANDARDS:
Established regulations concerning lot areas, yard setbacks, building height, lot coverage, open green space and any other special regulations deemed necessary to accomplish the purpose of this title.
STABLE, PRIVATE:
A detached accessory building for the keeping of the livestock animals owned by the occupants of the premises and not kept for commercial purposes.
STABLE, PUBLIC:
A stable other than a private stable.
STABLE OF LIVESTOCK:
A stable that is used for housing livestock and performing tasks related to it.
STANDS FOR SALE OF PRODUCE:
An establishment where produce is sold.
STORAGE, BAILING, AND PROCESSING OF WOOD, GLASS, PAPER, AND JUNK:
An establishment that stores, process, and bails material.
STORAGE RENTAL UNITS:
A structure that is used for renting storage and does not have a door or other entranceway into a dwelling unit and that does not have water fixtures within its confines, the use of which is limited solely to storage of inanimate objects.
STORY:
The space within a building included between the surface of any floor and the surface of the ceiling next above.
STORY, HALF:
A story with at least two (2) of its opposite sides situated in a sloping roof, the floor area of which does not exceed two-thirds (2/3) of the floor immediately below it.
STREET:
A public thoroughfare which affords principal means of access to abutting property and is dedicated and improved to county standards.
STRUCTURAL ALTERATIONS:
Any change in supporting members of a building, such as bearing walls, columns, beams or girders.
STRUCTURE:
Anything constructed or erected, which requires location on the ground or attached to something having a location on the ground.
SUBDIVISION:
Means any land that is divided, or proposed to be divided, into two or more lots, or other division of land for the purpose, whether immediate or future, for offer, sale, lease, or development either on the installment plan or upon any and all other plans, terms, and conditions. The division or development of land, whether by deed, metes and bounds description, devise and testacy, map, plat, or other recorded instrument, regardless of whether the division includes all or a portion of a parcel or lot, except a bona fide division or partition of agricultural land for agricultural purposes meeting the requirements of Utah Code Ann. 17-27a-605, as amended.
SUBDIVISION AMENDMENT:
Means an amendment to a recorded subdivision in accordance with Utah State Code that:
A.   Vacates all or a portion of the subdivision;
B.   Alters the outside boundary of the subdivision;
C.   Changes the number of lots within the subdivision;
D.   Alters a public right-of-way, a public easement, or public infrastructure within the subdivision; or
E.   Alters a common area or other common amenity within the subdivision.
SUPERMARKET:
A retail establishment primarily selling food, as well as other convenience and household goods.
SWIMMING POOL, PRIVATE:
Any structure intended for swimming, recreational bathing or wading that contains water over twenty four inches (24") (610 mm) deep. This includes in ground, aboveground and on ground pools; hot tubs; spas and fixed in place wading pools for three (3) homes or less.
TAVERN:
Any place in which fermented malt beverages or intoxicating liquors are sold for consumption upon said premises.
TEMPORARY GUEST:
Guests, who are not family members, whose duration of visit shall be less than thirty (30) days during a consecutive one hundred eighty (180) day period.
TEMPORARY STRUCTURE OR ENCLOSURE:
Any movable, tent like structure or enclosure intended as a temporary dwelling such as a tent, yurt, tepee, RV, trailer, park model, or any movable structure intended to provide protection from the elements such as a temporary garage or storage unit. Such temporary enclosures are considered structures under this definition, and as such are governed by the same setback requirements as other structures. Tents set up for special occasions, screen houses, and other such seasonal, recreational enclosures are specifically exempted from this definition unless used for storage as listed above. Allowed as a conditional use in open space, agriculture, seasonal forest residential, and forest residential zones, in approved campgrounds, and where rural recreation grounds and facilities have been approved.
TESTING LABORATORY:
A laboratory that is used for the testing of material, substances from the body, or any things like unto it.
THEATER, INDOOR:
An indoor structure used for dramatic, operatic, motion pictures, or other performance, for admission to which entrance money is received and no audience participation or meal service allowed.
THEATER, OUTDOOR:
A theater that is outdoor.
TIMESHARE:
A facility in which the exclusive right of use, possession, or occupancy of dwelling units circulates among the various owners or lessees thereof in accordance with a fixed time schedule on a periodically recurring basis.
TIRE RECAPPING OR RETREADING:
An establishment that recaps and retreads tires.
TIRE SALES AND SERVICE:
A place where the principal business is the sale or installation of new, used, or retread tires and tubes.
TOWNHOUSES OR CONDOMINIUMS WITH A PROJECT OF FOUR (4) DWELLING UNITS:
A building on its own separate lot containing one dwelling unit that occupies space from the ground to the roof, and is attached to one or more other townhouse dwelling unit by at least one common wall.
TOY STORE, RETAIL:
An establishment that specializes in selling toys.
TRAIL CONSTRUCTION AND TRAIL RIDES:
The act of creating and maintaining trails and the enjoyment thereof.
TRAILER SALES AND SERVICE:
An establishment that primarily sells, buys, trades, and/or repairs trailers at retail.
TRANSMISSION LINES:
Overhead utility lines for the transmission of electricity between generation or switching facilities and local distribution systems.
TRUCK SALES AND REPAIR:
An establishment that primarily sells and repairs trucks.
TRUCK TERMINAL:
A building or area in which freight brought by motor truck is assembled and/or stored for routing in interstate shipment by motor truck.
UNDEVELOPED PRIVATE LAND:
Land that is not open to the public and in its natural state before development.
UNDEVELOPED STATE AND INSTITUTIONAL LAND PROPERTY:
Land that is in its natural state before development and institutionally owned.
UNLICENSED REHABILITATION/
TREATMENT FACILITY:
A facility providing temporary occupancy for individuals (adult/juvenile) in order to provide rehabilitation, treatment or counseling services, which facility either does not require licensure by the state of Utah or does not operate under contract with the State of Utah. Without limitation, such services may include rehabilitation, treatment or counseling services related to delinquent behavior, alcohol and drug abuse, sex offenders, sexual abuse or mental health.
USE, ACCESSORY:
A subordinate use customarily incidental to and located upon the same lot occupied by a main use.
USED CAR LOT:
An establishment that buys, sells, trades, and / or repairs used cars for retail.
VARIETY STORE:
An establishment that sells a wide range of inexpensive items.
VEGETABLE STAND:
An open-air business venue that sells primarily vegetables from local growers.
VETERINARIAN:
A person qualified to treat diseased or injured animals.
VETERINARY CLINIC:
An establishment for the care and treatment of small animals, including household pets.
WAREHOUSE STORAGE:
A use engaged in storage, wholesales, and distribution of manufactured products, supplies, and equipment.
WEANER PIGS, HOUSING:
An establishment for the holding of pigs that have just been weaned.
WELDING SHOP:
An establishment that is for the purpose of welding.
WIDTH OF LOT:
The distance between the side lot lines at the distance back from the front lot line required for the depth of the front yard.
YARD, FRONT:
A space on the same lot with a building between the front line of the building and the front lot line, and extending across the full width of the lot.
YARD, REAR:
A space on the same lot with a building, between the rear line of the building and the rear line of the lot and extending the full width of the lot.
YARD, SIDE:
A space on the same lot with a building between the side line of the building and the side line of the lot and extending from the front yard line to the rear yard line.
YOUTH ENTERPRISE:
A business operated by persons under eighteen (18) years of age, which is normally considered to be a business a child would run and will not impact the residential character of the neighborhood. These businesses would typically include lemonade stands, door to door fundraisers, a small yard care service, babysitting, and other similar uses. These enterprises shall be exempt from the home occupation requirements of Chapter 26 of this title.
