7-4-5: SEASONAL ROAD CLOSURES:
   A.   Definitions:
   DIRECTOR: The Public Works Director or his designee.
   SEASONAL ROADS: Roads that are not plowed by the county during the Snow Season are called Seasonal Roads, and include:
      1.   Private roads;
      2.   Gravel, dirt, natural, or unpaved roads;
      3.   Class D roads;
      4.   Class B roads depicted on the Winter Maintenance Road Map as not plowed;
      5.   All other roads constructed after the passage of this chapter in the area or vicinity of the Seasonal Roads on the Winter Maintenance Road Map.
   SEASONAL ROAD AREAS: If a new road is constructed after the passage of this chapter in the same area or vicinity of the Seasonal Roads on the Winter Maintenance Road Map, it also will not be plowed by the county during the Snow Season.
   WINTER SEASON: The period of November 1st to April 15th, or the dates directed by the Public Works Director or designee.
   WINTER MAINTENANCE ROAD MAP (“WMR MAP”): The map that designates the paved Seasonal Roads that will be plowed by the county during the Snow Season.
   B.   Snow and Ice Removal Priorities. The Director or designee shall determine the order, priority, and method of snow or removal on all county roads or rights of way based on all reasonable factors and those set forth in this chapter. Snow or ice removal by the county will not commence on a roadway until the road is constructed and officially accepted by the county.
   C.   Unplowed Roads during the Winter Season. Seasonal Roads and Seasonal Road Areas on the WMR Map will not be plowed or maintained by the county during the Winter Season defined as November 1st through April 15th. If the Director or designee determines that the Winter Season should begin earlier or extend later due to significant weather events, it may be altered by notice on the county website with links on the Public Works page.
   D.   Maintaining the Winter Maintenance Road Map. The Director or designee shall maintain the WMR Map and post it on the county’s website with links on the Public Works page. Minor updates to the WMR Map may be made by the Director or designee. Significant updates shall be made by the county legislative body. A determination of whether the updates are minor or significant is in the discretion of the Director or designee.
   E.   Seasonal Road Access. By this chapter, any lot, parcel, or development that obtains access by a Seasonal Road, or that is in a Seasonal Road Area as set forth on the WMP Map, is on notice that the lot or parcel is accessed by roads that will not be plowed by the county. The county also may require Seasonal Road restriction language on any building permit, plat, or by a recorded deed restriction to the county’s satisfaction, that it will not plow the public or private access roads to the lot, parcel, or development. It is the owner, builder, and developer’s responsibility to familiarize themselves with this chapter and the access limitations to the lot, parcel, or development.
   F.   Interlocal Cooperation Agreements. The Director or designee shall have the authority to negotiate interlocal cooperation agreements with other public entities for the repair, maintenance, or snow removal on public roads or rights of way, and have such agreements approved and executed in accordance with state law.
