7-3-1: COUNTY POWERS AND LIMITS:
The county may purchase, acquire, design, construct, maintain, control, and manage county roads and rights of way. The county may by ordinance vacate or abandon all or a portion of a county road or right of way in accordance with state law. Except as provided in Utah Code Ann. § 72-5-305, as amended, if the county vacates all or a portion of a county road or right of way, the state’s interest in the road or right of way also is vacated. The county may change the name of a county road. The county may designate and maintain roads within or extending through a city or town if the roads do not exceed three in the same direction. The county has no responsibility to provide maintenance or services on public roads that are not county roads, county roads under the jurisdiction of another governmental entity or special service district, or private roads.
