A. Regulations: These regulations shall apply to all buildings and structures in the unincorporated territory of Washington County, Idaho, except as set forth in subsection B of this section.
B. Exceptions: Agricultural buildings shall be exempt from the requirement of the building code. "Agricultural buildings" are defined as structures located on agricultural zoned property and on land that meets the definition of land actively devoted to agriculture in Idaho Code 63-604 (as determined by the Washington County Assessor) and are designed and constructed to house farm implements, hay, grain, poultry, livestock or other horticultural products. A Farm Shop with toilet facilities shall be considered an agricultural building provided that it is located on agricultural zoned property and on land that meets the definition of land actively devoted to agriculture in Idaho Code 63-604 (as determined by the Washington County Assessor). Toilet facilities may include the following: sink, toilet, shower, bathtub. This structure (agricultural building) shall not be a place of human habitation or a place of employment where agricultural products are processed, treated or packaged, nor shall it be a place used by the public.
The owner may complete an agricultural building declaration with the Planning and Zoning Administration, or other person designated by the Board of County Commissioners. The agricultural building declaration shall be accepted if the completed document conforms with the requirements of Title 5 Zoning of this code, Title 7 Flood Control of this code, and falls within the parameters outlined in this section of an agricultural building. The agricultural building declaration shall include a site location and building dimensions of the proposed structure(s) as well as setbacks. Engineered plans are not required.
C. Administrator: The administrator of the building codes and this chapter shall be appointed by the county commissioners of Washington County, Idaho.
D. Appeals: The planning and zoning commission shall act as the board of appeals of the provisions of this chapter.
E. Violations: Any person who wilfully violates any provisions of this chapter, or who wilfully violates any provisions of the codes adopted herein, is guilty of a misdemeanor and upon conviction shall be fined not more than three hundred dollars ($300.00) or imprisoned for not more than ninety (90) days or by both such fine and imprisonment.
