3-1-4: ADMINISTRATION:
   A.   Regulations: These regulations shall apply to all buildings and structures in the unincorporated territory of Washington County, Idaho, except as set forth in subsection B of this section.
   B.   Exceptions: Agricultural buildings shall be exempt from the requirement of the building code. "Agricultural buildings" are defined as structures designed and constructed to house farm implements, hay, grain, poultry, livestock or other horticultural products. This structure shall not be a place of human habitation or a place of employment where agricultural products are processed, treated or packaged, nor shall it be a place used by the public. The owner shall file an agriculture declaration with the building official prior to construction.
   C.   Administrator: The administrator of the building codes and this chapter shall be appointed by the county commissioners of Washington County, Idaho.
   D.   Appeals: The planning and zoning commission shall act as the board of appeals of the provisions of this chapter.
   E.   Violations: Any person who wilfully violates any provisions of this chapter, or who wilfully violates any provisions of the codes adopted herein, is guilty of a misdemeanor and upon conviction shall be fined not more than three hundred dollars ($300.00) or imprisoned for not more than ninety (90) days or by both such fine or imprisonment.
