A. Short Title: This section shall be known and cited as the WASHINGTON COUNTY SPECIAL REGULATIONS ORDINANCE.
B. Purpose; Application Of Provisions: It is hereby declared to be the duty of the board of county commissioners to establish guidelines for the reduction of allowable weight, or size, or permissible speeds of vehicles traveling on county highways if it is the opinion of the board of county commissioners that operation of vehicles of legal weight or size, or at legal speed limits will cause damage to the road by reason of climatic or other conditions or will interfere with the safe and efficient use of the highway by the traveling public.
These regulations shall apply to all county highways within the unincorporated territory of Washington County.
C. Authority To Regulate; Signs Posted:
1. When, in the opinion of the road and bridge supervisor, that operation of vehicles of legal weight or size, or at legal speed limits, will cause damage to any roadways by reason of climatic or other conditions, or will interfere with the safe and efficient use of the highway by the traveling public, and such facts are made known to the county board of commissioners, the road and bridge department shall be instructed to and shall erect and maintain signs designating the limitations of weight, size or speed at each end of such highway or section of highway and at major intersections. Upon posting of such restrictions, it shall be unlawful for any person to drive or operate a vehicle on such portion of the highway at a weight or size or speed greater than that shown on the sign designating the limitations. Said limitations shall be in effect until such time as the road and bridge department removes said signs.
2. Notice of reduced or allowable weight or size or permissible speed of vehicles shall be given by posting of signs as herein provided, and in no other way.
D. Violation And Penalty: It shall be unlawful and constitute a misdemeanor for any person to violate any provision of this section, and any person convicted of such violation shall be subject to punishment by a fine of not to exceed one hundred dollars ($100.00) or by imprisonment in the county jail for not more than thirty (30) days for each offense.
