§ 34.04 DECLARATION OF GENERAL EMERGENCIES.
   (A)   The City Manager may declare a general emergency for all or part of the city due to natural or man-made disasters, such as tornadoes, high winds, floods, gas leaks, riot, fire, willful or accidental acts of destruction by person(s), and the like.
   (B)   The City Manager may eliminate vehicular parking, restrict or prohibit the movement of vehicular traffic on the streets and alleys, and restrict or prohibit all access thereto of any street, alley or public way.
   (C)   When a general emergency is declared, the City Manager or his or her designee shall immediately inform the public of the general emergency condition by issuing a press release to the local news media as appropriate. The general emergency condition shall continue in effect until the City Manager declares it to be over and provides a similar press release as indicated in this division.
   (D)   Within one hour after the proper notification to the news media, the provisions of this section shall be in full force and effect and a general emergency shall exist.
   (E)   After such general emergency has been declared, the vehicle of any motorist which is found parked or becomes stalled by any reason whatsoever within the designated general emergency area is subject to being towed. Where a vehicle is towed, the vehicle may be recovered upon the payment of the appropriate towing and storage charges imposed. No unauthorized pedestrians within the designated general emergency area shall be permitted. Violation of this section is punishable as a minor misdemeanor with the appropriate fines and restrictions.
   (F)   Nothing contained within this section shall be construed to limit or prohibit the City Manager or the City Manager's designee from imposing other lawful exercises of the powers of the office of City Manager in relation to vehicular traffic, the blocking of streets or other emergency powers granted by the Charter of the city, the Codified Ordinances of the city, federal law or the Ohio Revised Code.
