§ 50.01 PRIVATE WELL WATER CONSTRUCTION PROHIBITED.

   (A)   Prohibition. Any private water well construction within the village limits shall be prohibited.

   (B)   Variance. The village retains the right to grant a variance from the prohibition as contained within this section in exceptional cases; provided that the petitioner for said variance proves that the location of the water well is not within 200 feet of a contaminated or potentially contaminated source of ground water, and proves compliance with:

      (1)   The Illinois Water Well Construction Code, 415 ILCS 30/1 et seq;

      (2)   The Illinois Water Well Pump Installation Code, 415 ILCS 35/1 et seq.;

      (3)   The Water Well and Pump Installation Contractor’s License Act, 225 ILCS 345/1 et seq.;

      (4)   Environmental Protection Act, 415 ILCS 5/1 et seq.; and

      (5)   Water Well Construction Code, 77 Ill. Adm. Code 920 and the Illinois Water Well Pump Installation Code, 77 Ill. Adm. Code 925.
