(A) The subdivider of any tract or parcel of land located within the corporate limits of the city or within that part of the unincorporated territory of Gallatin County shown on the map entitled “City of Warsaw Major Street Plan” adopted shall not proceed with any construction work including grading on the proposed subdivision which may affect the arrangement of streets, or to transfer, sell, agree to sell, or negotiate to sell any lot or parcel located within the proposed subdivision until he has obtained from the Planning and Zoning Commission the tentative approval of the preliminary plat of the proposed subdivision. Where the proposed subdivision does not involve the laying out of new streets or the grading, paving, and installation of water and sewer lines in streets which shall have acquired the legal status of public streets prior to the adoption of these regulations, the subdivider may submit a final plat without having submitted a preliminary plat.
(B) Application for such tentative approval shall be made in writing by the owner of the tract or parcel or by his authorized agent to the Planning and Zoning Commission and filed with the Secretary of the Commission. One copy of the preliminary plat shall be filed with the application.
(C) The preliminary plat shall be drawn to a scale of 100 feet or less to the inch horizontally and 20 feet or less to the inch vertically and shall contain:
(1) The proposed name of the subdivision.
(2) Its location as forming a part of some larger tract or parcel of land referred to in the indexes of the records of Gallatin County.
(3) The name and address of the person to whom the notice of the hearing shall be sent.
(4) The names and addresses of the owners of the land immediately adjoining the land to be platted.
(5) The names and addresses of the subdivider and of the engineer or surveyor.
(6) Sufficient information to accurately locate the land included in the plat.
(7) North-point and scale.
(8) The boundary lines of the tract to be subdivided accurate in scale and bearing.
(9) The location, widths, and other dimensions of all existing or platted streets and other important features such as railroad lines, water courses, exceptional topography, etc. within and contiguous to the tract to be subdivided.
(10) The location, widths, and otherr dimensions of proposed streets, alleys, easements, and lots.
(11) Existing sanitary sewers, storm drains, and culverts within the tract immediately adjacent thereto.
(12) All parcels of land intended to be dedicated for public use or reserved for the use of all property owners with the same purpose indicated.
