(A) A person is guilty of loitering when he remains in a public place with no legitimate purpose except to perform criminal activity, including trespassing, littering, harassing, threatening legitimate property users, and/or criminal mischief. Violation of this section shall be considered a class B misdemeanor with punishment of fine $5 to $250 and/or up to 90 days in jail.
(B) The property owner upon whose property the loitering is occurring shall post a sign, at his own expense, listing this section of the city code and notifying the public that there shall be no loitering subject to the punishment of this section.
