§ 71.64 DATA COLLECTION AND REPORTING.
   (A)   Upon the agency's election to participate in the collection of data as it relates to vehicle stops and racial profiling, officers shall obtain the race, ethnicity and gender of all persons as required above. The officer shall not solicit such information from the affected individuals, but the information shall be derived from the officer's observations of the race, ethnicity, and gender or the officer's perception of the individual's race, ethnicity and gender. No information shall be placed on the form to establish the actual identity of the individuals who have been stopped, cited, searched or who have had property seized.
   (B)   Subsequent to all vehicle stops made by an officer, all required information concerning the race, ethnicity and gender of the driver and occupants of the motor vehicle shall be entered on the KSP Vehicle Stop Reporting Form.
   (C)   The completed KSP Vehicle Stop Reporting Forms shall be forwarded to the Secretary of Justice, or his designee, who shall compile an annual report based on the fiscal year (July 1 through June 30). The Secretary of Justice shall deliver a composite report of the submitting agencies to the Governor and appropriate members of the Kentucky General Assembly by October 1st of each year.
