§ 51.065 NO REDUCTION IN WATER CHARGE; EXCEPTION.
   No reduction in the water charge shall be made for any water services provided by the city to any property connected to the city water system; except the city may provide a one-time reduction in the water charge to a property owner not connected to the city sewer system when it can be shown that the water use was abnormally excessive due to no fault of the property owner, and when it is shown that the problem that caused the excessive water use has been corrected. In order for the city to consider the reduction in the water charge due to an abnormal excessive use, the property owner must present substantial evidence to the city showing the reason for the excessive use and that the reason has been eliminated. The city can reduce the water charge one time for the owner(s) of the property and for only one month of water charges. When the foregoing standards have been met, the city shall use the following formula to determine the reduce water charge in situations arising herein:
   (A)   Current water charge - Average of the last 12 months water charge =   Average of the last
               2                     12 months water charges
   (B)   In words, the formula will read: The adjusted water bill shall equal: (the current water charge) minus (the average of the last 12 months water charges), divided by two; plus (the average of the last 12 months water charges).
   (C)   Example: if the current water charge is $200 and the average bill for the last 12 months is $40, the adjusted bill to be paid would be $120.
      (1)   The calculation would be: 200-40 + 40 = 120;

      (2)   $200 minus $40 equals $160; divided by 2 equals $80; plus $40 equals $120.
