(a) No person shall install, construct or use for the purpose for which such is designed, any hibachi, outdoor barbecue grill or any other grill, broiler or oven of the domestic variety commonly used for outdoor cooking or other similar utensil, at any place in the City other than upon the backyard ground floor level of a premises and then only if such utensil is located fifteen feet or farther away from any dwelling, garage or other structure or part thereof.

(b) No person shall fail to extinguish any fire or burning embers with water or other suitable means in any hibachi, outdoor barbecue grill or any other grill, broiler or oven of the domestic variety commonly used for outdoor cooking, or other similar utensil, after the use of such utensil for cooking has been terminated.
(c) No person shall fail to take whatever measures are necessary to prevent the spread to the surrounding area of hot sparks or burning embers or coals from the pit of any hibachi, outdoor barbeque grill or any other grill, broiler or oven of the domestic variety commonly used for outdoor cooking or other similar utensil. Any fire or other damage or injury which in the judgment of the Fire Chief is occasioned by the spread of hot sparks or burning embers or coals as aforesaid shall constitute prima-facie evidence of an intent, on the part of the owner of the premises upon which the utensil is located, to violate this section.

(d) Whoever violates any of the provisions of this section is guilty of a minor misdemeanor.
