521.08 LITTERING AND DUMPING.
   (a)    Littering and Deposit of Garbage, Rubbish, Junk, Etc.
      (1)   No person shall, without lawful authority, place or dispose of in any manner, upon any public property, his own property or upon the premises of another, any paper, trash, garbage, waste, rubbish, refuse, recyclables or junk.
      (2)    A.    Trash, rubbish, garbage, refuse, recyclables and litter properly contained may be placed on tree lawns or next to the curb for collection not sooner than 7:00 p.m. the day before the scheduled collection.
         B.    No person shall cause or permit trash, rubbish, garbage, refuse, recyclable or litter containers to remain between the building setback line and the tree lawn or the curb beyond 7:00 p.m. on the day of their garbage and rubbish collection. If trash, rubbish, garbage, refuse, recyclables or litter is set out after the regularly scheduled pickup time, any items not picked up must be removed from the tree lawn or curb by 12:00 p.m. on the day of garbage and rubbish collection.
         C.    No person shall cause or allow trash, garbage, waste, rubbish, refuse, recyclables or any other noxious or offensive material or substance to be placed between the building setback line and the tree lawn or the curb.
      (3)    No person shall cause or allow trash, garbage, waste, rubbish, refuse, recyclables or any other noxious or offensive materials or substances to be collected or remain in any place to the damage or prejudice of others or of the public, or unlawfully obstruct, impede, divert, corrupt or render unwholesome or impure, any natural watercourse.
      (4)    No person in charge of the transportation of material or the owner or person in charge of any premises within the City shall allow or cause the littering or deposit of dirt, debris or other material upon the sidewalks and streets of the City. For the purposes of this section, the dropping of mud, dirt or other material from the wheels of vehicles used in the transportation of materials shall be considered within the definition of littering or depositing.

   (b)    Dumping and Dumping Grounds.
      (1)    No person shall use or permit the use of any ground as a location for the deposit or dumping of refuse material by other than the owners of such ground without first obtaining a permit therefor from the Mayor, which permit shall be issued by the Mayor without charge, but shall be subject to revocation at any time, upon finding by the Mayor that the use of such grounds does not conform to the requirements of this section.
      (2)    No person, other than the owner, shall deposit or dump any material upon such grounds without the permission of the owner, and the owner may prescribe the terms and conditions upon which material may be deposited thereon.
      (3)    No material shall be deposited on any such ground which is deleterious to the public health, or which, is, or is liable to cause or become, a public nuisance, and such ground at all times shall be kept and maintained in a safe and sanitary condition and in a condition which does not constitute a public nuisance.

   (c)    Whoever violates subsection (a) hereof is guilty of a minor misdemeanor. Whoever violates subsection (b) hereof is guilty of a misdemeanor of the first degree.
