1379.03 DEFINITIONS.
   (a)   "Administrator" means the person responsible for the daily operation of a Type A Home, or Type B Home Daycare. The Administrator and the Owner may be the same person.
   (b)   "Child care" means all of the following:
      (1)   Administering to the needs of infants, toddlers, preschool-age children, and school-age children outside of school hours;
      (2)    By persons other than their parents, guardians, or custodians;
      (3)   For any part of the twenty-four-hour day;
      (4)   In a place other than a child's own home, except that an in-home aide provides child care in the child's own home; and
      (5)   By a provider required by Chapter 5104 of the Ohio Revised Code to be licensed or approved by the Ohio Department of Job and Family Services, certified by the Cuyahoga County Department of Job and Family Services, or under contract with the department to provide publicly funded child care as described in section 5104.32 of the Ohio Revised Code, or operating an unlicensed Type B Home Daycare.
   (c)   "Child-care staff member" means an employee of a Type A or Type B Home Daycare who is primarily responsible for the care and supervision of children. The Administrator may also be a part-time child-care staff member when not involved in other duties.
   (d)   “Owner" means a person or individual, corporation, business trust, estate, trust, partnership, association or government entity that owns the Type A or Type B Home Daycare.
   (e)   "Type A Home Daycare" means a permanent residence of the Administrator or Owner in which child care or publicly funded child care is provided for seven (7) to twelve (12) children at one time or a permanent residence of the Administrator or Owner in which child care is provided for four (4) to twelve (12) children at one time if four (4) or more children at one time are under two (2) years of age. In counting children for the purposes of this definition, any children under six (6) years of age who are related to an Owner, Administrator, or child care staff member and who are on the premises of the Type A Home Daycare shall be counted. "Type A Home Daycare" does not include any child day camp.
   
   (f)   "Type B Home Daycare" means a permanent residence of the provider in which child care is provided for one (1) to six (6) children at one time and in which no more than three (3) children are under two (2) years of age at one time. In counting children for the purposes of this division, any children under six (6) years of age who are related to the provider and who are on the premises of the Type B Home Daycare shall be counted. "Type B Home Daycare" does not include any child day camp.
