Subject to the conditions set forth in this chapter, the public official or public employee shall be entitled to be represented by the City Law Department and in the event it is determined that a conflict of interest would exist in the representation of the public official or public employee by the City Law Department, then the public official or public employee is entitled to be represented by counsel of his choice, provided, that such counsel is approved by Council and in no event shall private counsel be entitled to a rate in excess of the rate that the City provides its Chief Legal Counsel at that time.
