167.08 SICK LEAVE.
   (a)   After six (6) months of continuous service, with the City of Warrensville Heights, each full time administrative employee shall receive a credit of forty hours of paid sick leave and shall continue to accrue sick leave at a rate of four and sixty-hundredths (4.62) hours per bi-weekly pay period up to a maximum of 120 hours annually. In accordance with the Ohio Revised Code, prior public service sick leave may be transferred upon employment with the City of Warrensville Heights up to 2080 hours. Employees not governed by a collective bargaining agreement may accumulate an unlimited amount of sick leave and shall be entitled to use sick leave for their illness or the illness of a qualifying family member provided the employee can provide medical documentation which is satisfactory to the department head and the Mayor.
   (b)   Notwithstanding the unlimited accumulation of sick leave provided for in subsection (a) hereof, upon separation from the City of Warrensville Heights by service or disability or retirement, with no less than ten (10) years of public service, an employee may receive payment for 25% of unused sick leave earned and accumulated during employment with the City up to a maximum payment of 30 days or 240 hours of such unused sick leave. Upon separation from the City by means other than retirement with less than ten (10) years of public service and/or accumulated unused sick leave of less than 120 days or 960 hours, an employee may request to transfer the remaining balance to another public employer, or receive payment of 25% of the remaining unused sick leave balance earned and accumulated during employment with the City up to a maximum of 30 days or 240 hours. For clarification, an employee separated from the City for any reason, including service, disability, termination or retirement, shall only receive payment of 25% of unused sick leave that was earned and accumulated during employment with the City and not for unused sick leave transferred to the City pursuant to subsection (a) above.
