(a) Stormwater facilities shall be designed, maintained and operated in accordance with this chapter and the Warrensville Heights Stormwater Design Guide.
(b) Stormwater management facilities must be sized in accordance with Ohio EPA General Permit OHC000002. Warrensville Heights’ requirements for stormwater quality will be the same as those stated in the current Ohio EPA requirement. When Ohio EPA General Permit OHC000002 expires on April 20, 2008, the permit requirements will remain in effect in the City until the Ohio EPA permit is renewed or updated by the Ohio EPA. When the Ohio EPA permit is renewed or updated, the more current requirements will take effect in the City.
(c) All stormwater management facilities shall be designed to ensure compliance with Ohio Water Quality Standards (OAC Chapter 3745-1).
(d) The City of Warrensville Heights encourages the use of low impact development techniques which minimize impervious area and maximize open space. The City Engineer may require investigation into the use of low impact development techniques prior to site plan approval.
(e) The stormwater conveyance system (the combination of storm sewers and overland stormwater routing) shall be designed, maintained and operated in order to convey the 100-year, 24-hour design storm and prevent structural flooding in accordance with this chapter and the Warrensville Heights Stormwater Design Guide.
(f) Stormwater management practices and related activities shall not be constructed in water resources unless the applicant shows proof of compliance with all appropriate permits from the Ohio EPA, the U.S. Army Corps, and other applicable federal, state, and local agencies as required by this chapter, and the activity is in compliance with City’s Erosion and Sediment Control Ordinance and the City’s Riparian Setback Ordinance, all as determined by the City Engineer.
(g) Peak stormwater discharges from the site must be controlled in accordance with the Warrensville Heights Stormwater Design Guide.
(h) During construction and after construction, stormwater discharges from the site must be controlled in such a manner to avoid creating a detriment to surrounding properties.
(i) All stormwater management facilities shall be inspected and maintained in accordance with the Long Term Inspection and Maintenance Agreement required by this chapter. All stormwater management facilities must be inspected annually by an agent of the City.
(j) Unless otherwise required by the City Engineer, all permanent stormwater management facilities serving multiple lots shall be maintained by the owner or a private common ownership entity (such as a homeowner’s association). Stormwater management facilities serving single lots shall be placed on these lots, protected within an easement, and maintained by the property owner.
(k) Offsite stormwater runoff that discharges to or across the development site shall be conveyed through the stormwater conveyance system planned for the development site at its existing peak flow rates during each design storm. Offsite flows shall be diverted around stormwater quality control facilities or, if this in not possible, the stormwater quality control facility shall be sized to treat the offsite flow. Stormwater Management Plans will not be approved until it is demonstrated to the satisfaction of the City Engineer that offsite runoff will be adequately conveyed through the development site in a manner that does not exacerbate upstream or downstream flooding and erosion.
(l) For development or redevelopment occurring on a previously developed site, an applicant shall still be required to submit a stormwater management plan and control stormwater in accordance with this chapter and the Warrensville Heights Stormwater Design Guide, to the maximum extent practical.
