923.13 INSPECTION OF RIPARIAN AND WETLAND SETBACK.
   (a)   The field delineation of riparian and/or wetland setbacks may be inspected by the City, as follows:
      (1)   Prior to any soil disturbing activities. Setback Protection Fencing must be shown on the Stormwater Pollution Prevention Plan in order for the plan to be approved. Setback Protection Fencing must be placed in the field prior to any soil disturbing activities. Issuance of a Footing and Foundation Permit will be withheld until the riparian and wetland setbacks are clearly marked on site in accordance with this chapter.
      (2)   Prior to starting any of the activities authorized by the City under the “Uses Permitted in Riparian and Wetland Setbacks” section of these regulations, the applicant or his or her designated representative shall provide the City with at least five (5) working days notice prior to starting such activities.
   (b)   The Riparian Setback may also be inspected annually or as time permits by the City for compliance with any approvals under these regulations or at any time evidence is brought to the attention of the City that uses or structures are occurring that may reasonably be expected to violate the provisions of these regulations.
