(a) If the City’s Stormwater Management Ordinance requires the submittal of a Preliminary Stormwater Management Plan, the plan should indicate the estimated location of any required Riparian and Wetland Setbacks.
(b) If the City’s Stormwater Management Ordinance requires the submittal of a Stormwater Management Plan, the submittal information required by this chapter shall be included with the Stormwater Management Plan.
(c) For any sites which do not submit SWM Plans (i.e. less than 1 acre) for which development, redevelopment, or general clearing is proposed within a riparian or wetland setback area, submit the required submittal information at the same time as the Preliminary Plan is submitted to the Planning Commission.
(d) For uses listed in this chapter as “Permitted by Right within the Riparian Setbacks with Prior approval of the Design by the City Engineer”: The applicant must contact the City Engineer to request approval for the requested use. The submittal information and review fee which will be required by the applicant will depend on the nature of the requested use.
(e) If Riparian or Wetland Setbacks are required for a site, the following information must also be submitted:
(1) For any watercourse which is considered a Designated Watercourse in accordance with this chapter, the proposed ordinary high water level must be clearly identified on the plan.
(2) An explanation of how any 100-year floodplain was determined. Back-up information may be requested by the City Engineer.
(3) A copy of a wetland delineation report issued by a qualified professional. The report should include documentation of the Ohio Rapid Assessment Method for wetland evaluation approved at the time of application of the regulations.
(4) Please refer to the Warrensville Heights Stormwater Design Guide for specific submittal requirements.
(f) The fee related to the engineering review of the submittal and the field inspection of the setback will be paid out of the Stormwater Review and Inspection Fee. This fee shall be paid in accordance with the City’s Stormwater Management Ordinance.
(g) The City shall review the plans for conformance with this regulation and approve, or return for revisions with comments and recommendations for revisions. A plan rejected because of deficiencies shall receive a narrative report stating specific problems and the procedures for filing a revised plan.
(h) Approvals issued in accordance with this regulation shall remain valid for two (2) years from the date of approval.
(i) In reviewing plans, the City may confer with the Cuyahoga SWCD, the Ohio Department of Natural Resources, Division of Natural Areas; the Ohio Environmental Protection Agency, Division of Surface Water; the County of Cuyahoga Engineer; or other state and federal agencies or technical experts as necessary.
