921.13 CONSTRUCTION SITE STORMWATER DEPOSIT.
   (a)   For all commercial or residential developments, a Construction Site Stormwater Deposit must be deposited for the City of Warrensville Heights to perform any stormwater management and/or erosion and sediment control related obligations otherwise to be performed by the owner of the construction site as stated in this regulation and in the City’s Stormwater Management Ordinance. This deposit shall finance all work to be performed as needed in the event that the applicant fails to comply with the provisions of these regulations. A stop-work order may be issued by the City to suspend any additional soil disturbing activity on the site until the site is in compliance with this regulation.
   (b)   The Construction Site Stormwater Deposit shall be in an amount adequate to finance all required work, and shall be, at a minimum, as follows:
      (1)   For a site 1 acre or smaller: $5,000
      (2)   For a site larger than 1 acre: $5,000 plus $1,500 for each additional acre. The acreage will be based on the total property area and must be rounded- up to the whole acre.
   (c)   The stormwater deposit will be returned, less City administrative fees, when 100% of the total project has been permanently stabilized, Final Inspection and Acceptance of Site Stabilization has been granted by the City Engineer (including as-built certification), and the Long Term Inspection and Maintenance Agreement is accepted by the City (if applicable).
   (d)   No soil-disturbing activities shall be permitted until the Construction Site Stormwater Deposit has been deposited with the City Building Department.
   (e)   A Construction Site Stormwater Deposit is not required for an individual residential lot. Alternatively, if the individual lot is found to be out of compliance with this regulation, two violation letters will be issued which detail the required correction and timeline. If the required corrections are not made to the satisfaction of the City, a stop-work order will be issued to suspend all construction activity. Construction activity will be ordered stopped until the site is brought into compliance with the regulations of the City and the City Engineer or a representative of the Building Department has determined that work may resume.
