(a) For soil disturbing activities requiring a SWP3 or Abbreviated SWP3, the applicant shall submit 3 sets of the SWP3 or Abbreviated SWP3 to the City as follows:
(1) For improvement projects, the SWP3 or Abbreviated SWP3 shall be submitted with the improvement plans. Final approval for the improvement plans and issuance of a Footing and Foundation Permit will be withheld until the SWP3 or Abbreviated SWP3 has been approved. After the plan is approved by the City Engineer a letter of approval will be sent to the applicant. No soil disturbing activity will be allowed until this approval letter has been received by the applicant.
(2) For general clearing projects, the plan shall be submitted prior to any soil disturbing activity. After the plan is approved by the City Engineer a letter of approval will be sent to the applicant. No soil disturbing activity will be allowed until this approval letter has been received by the applicant.
(3) Absolutely no soil disturbing activities shall commence prior to obtaining approval for the SWP3 or Abbreviated SWP3.
(b) The City shall review the plans for conformance with this regulation and approve, or return for revisions with comments and recommendations for revisions. A plan rejected because of deficiencies shall receive a narrative report from the City Engineer stating specific problems and the procedures for filing a revised plan.
(c) The SWP3 or Abbreviated SWP3 for individual sublots in a subdivision will not be approved unless the larger common plan of development or sale containing the sublot is in compliance with this regulation.
(d) Approvals issued in accordance with this regulation shall remain valid for 1 year from the date of approval.
(e) In cases where a plan was approved by the City prior to this chapter taking effect, the requirements of this chapter will be in effect and enforced by the City unless construction is already underway and ongoing.
