109.02 CONTRACT COMPLIANCE BOARD.
   (a)   There is hereby established a Contract Compliance Board consisting of the Purchasing Agent, the Finance Director and a Councilman elected by majority vote of the members elected to Council. The Councilman shall serve on such Board for a period of one year commencing on January 1 of each year. The first Councilman who is appointed by Council shall serve for any additional period of time that he is appointed prior to January 1, 1971, in addition to his tenure of one year for the year 1971.
   (b)   The Board shall administer and enforce the City’s equal employment opportunity program established by this chapter, including, but not limited to, Section 109.03(c), establish procedures to effectuate this chapter, make all determinations as to compliance with the program and may meet with the contracting parties for such purposes. The Board shall have at its disposal the resources of the City’s several departments, the Community Relations Coordinator and other independent agencies, who may be under contract with the City.
   (c)   The Board, in determining whether or not an employer is complying with this chapter, shall use a rule of reason, that is, the rule of a reasonably prudent man.
   (d)   The Board can only make recommendations to Council, and Council shall have the authority to determine whether a contract should or should not be awarded.
