1513.05 BONFIRES, RECREATIONAL FIRES AND OUTDOOR RUBBISH FIRES.
   (a)    General. Burning of rubbish shall be prohibited throughout the City. Bonfires and recreational fires may be permitted only under the following conditions, pursuant to Section 1513.03, and subject to the air pollution provisions of this chapter.
   (b)    Permit Required. Where the jurisdictional Ohio EPA prior notification and written permission are not applicable as described in Section 1513.03, the City Fire Official shall give written permission provided that approved fire safety requirements and emission standards will be met. A person shall not kindle or maintain any bonfire or recreational fire or authorize any such fire to be kindled or maintained on any premises without having obtained a permit or other proper authorization from the City Fire Official. All permits shall be requested by and issued to the owner of the land upon which the bonfire is to be kindled.
   
   (c)    Location Restricted. A person shall not kindle or maintain any bonfire or recreational fire or authorize any such fire to be kindled or maintained unless:
           (1)    The location is approved by the City Fire Official and is not less than fifty feet from any structure and adequate provision is made to prevent fire from spreading to within fifty feet of any structure; or
           (2)    The fire is contained in an approved burner located safely not less than fifteen feet from any structure.
   (d)    Bonfire Size and Duration. A bonfire or recreational fire shall not be more than 5 feet by 5 feet by 5 feet in dimension and shall not burn longer than three consecutive hours. The maximum size and duration of a bonfire or recreational fire shall not be increased by the City Fire Official unless it is determined that fire safety requirements of the situation and the desirable duration of burn warrant the increase.
  
   (e)    Material. Fuel for bonfires and recreational fires shall consist of seasoned dry wood only and shall be ignited with a small quantity of paper only. Bonfires and recreational fires shall not contain any rubbish, garbage, trash, any material made of or coated with rubber, plastic, leather or petroleum based materials and shall not contain any flammable or combustible liquids. The allowable quantity of wood to be burnt shall be determined by the City Fire Official and shall be based upon the fire safety requirements of the situation and the desirable duration of burn.
   (f)    Attendance at Bonfires and Recreational Fires. Bonfires and recreational fires shall be constantly attended until the fire is extinguished. At least one portable fire extinguisher with a minimum 4-A rating, two portable fire extinguishers with a minimum 2-A rating each, or other approved on-site fire extinguishing equipment, such as dirt, sand, water barrel, garden hose, or water truck, shall be available for immediate utilization.
  
   (g)    Prohibited Bonfires and Recreational Fires. The City Fire Official may prohibit any or all bonfires or recreational fires when atmospheric conditions or local circumstances make such fire hazardous or which are or could be offensive or objectionable due to smoke or odor emissions. The City Fire Official shall order the extinguishment, by the permit holder or the Fire Department, of any bonfire or recreational fire which creates or adds to a hazardous or objectionable situation.
