1397.04 INSPECTION PRIOR TO ISSUANCE.
   (a)    Upon application for an occupancy permit, the Building Commissioner shall, with the approval and permission of the occupant, cause to be made an inspection of the premises covered therein. Such inspection shall be made for the purpose of determining compliance or noncompliance with the provisions of this Business Maintenance Code, Building Code, Zoning Code, Fire Prevention Code and other ordinances and regulations of the City applicable to the construction, alteration, maintenance, occupation or operation of business premises or business units. No new occupancy or change in occupancy shall take place prior to the issuance of such occupancy permit.
   (b)    If any owner, occupant, or other person in charge of the premises fails or refuses to permit free access and entry to the structure or premises under his control, or any part thereof, with respect to which an inspection authorized by this section is sought to be made, the Building Commissioner or his agent may, upon a showing that probable cause exists for the inspection and for the issuance of an order directing compliance with the inspection requirements, petition and obtain such order from a court of competent jurisdiction.
   (c)    Any person who refuses to comply with an order issued pursuant to this section shall be subject to such penalties as may be authorized by law for violation of a court order in addition to any other penalties provided by this chapter.
