1395.99 PENALTY.
   (a)    Whoever violates any of the provisions of this Business Maintenance Code, or any rule or regulation promulgated thereunder, or fails to comply therewith or with any written notice or written order issued thereunder, for which no other penalty is provided, is guilty of a misdemeanor of the first degree.
   (b)    The imposition of any penalty shall not preclude:
      (1)    The Building Commissioner or his or her designee from implementing a fine of two hundred fifty dollars ($250.00) for the first offense, five hundred dollars ($500.00) for the second offense, and seven hundred fifty dollars ($750.00) for each subsequent offense thereafter. At the discretion of the Building Commissioner, or his or her designee, a warning notice may be given for a first offense.
      (2)    The Director of Law or his or her designee from instituting an appropriate action or proceeding in a court of competent jurisdiction to restrain, correct or abate a violation or to require compliance with the provisions of this Business Maintenance Code.
   (c)    Each day such violation occurs or continues shall constitute a separate offense.
