901.05 REFILLING; FINAL INSPECTION; REMEDY OF CITY FOR DEFECTIVE WORK.
All street pavements, backfill, bedding, curbs, gutters, sidewalks, treelawns, landscaping, signs, fences, utilities and features within the Right of Way removed or damaged shall be replaced and repaired by such permittee under supervision of and to the satisfaction of the Director of Public Service. Inspection of the backfill operations and pavement restoration shall be coordinated with the Building Department and the City Engineer. If inspections are not coordinated 72 hours in advance and inspections do not occur, the City will hold the deposit for one (1) year prior to re-inspection of the finished repairs. If either inspection is to the satisfaction of the Director of Public Service, he shall so notify the Director of Finance, who shall thereupon return the guarantee deposit. If the inspection discloses a defect or unsatisfactory work that is unacceptable to the Director of Service, he shall notify the permittee of such defect or condition, and the permittee shall have ten days in which to rectify the same or forfeit the guarantee deposit, in which case the Municipality shall thereupon complete the repair or replacement. The City Engineer may act on behalf of the Director of Public Service, however, the Director of Public Service has the final word in case of a dispute.
