4-3-3: VANDALISM, PARENTAL RESPONSIBILITY:
   A.   Definitions:
   LEGAL GUARDIAN: A person appointed guardian, or given custody, of a minor by a circuit court of this state or a court of foreign jurisdiction, but does not include a person appointed, or given custody of a minor under the Illinois juvenile act 1 , or person given custody for school purposes only known as a "school guardian".
   MINOR: A person who is eleven (11) years of age, but not nineteen (19) years of age.
   PERSON: Any individual, firm, partnership, association, corporation, company or organization of any kind, including, but not limited to, municipality, school district or library district.
   PROPERTY OF ANOTHER: Any and all real estate, including improvements thereon, and any and all personalty, tangible or intangible, in which the offender has no interest therein.
   B.   Offenses: No person, including a minor, shall, within the corporate limits of the city:
      1.   Knowingly damage any property of another person without his consent; or
      2.   Knowingly and wilfully, by means of fire or explosive, damage any property of another person; or
      3.   Knowingly start a fire on the land of another person without his consent;
      4.   Knowingly place graffiti on public or private property in violation of section 4-3-10 of this chapter; or
      5.   Knowingly deposit on the land or in a building of another person without his consent any stink bomb or other offensive smelling compound and thereby intend to interfere with the use by another of the land or building. (Ord. 1553, 12-16-1996)
   C.   Penalty: Whoever commits any of the heretofore stated acts shall be fined as provided in section 1-4-1 of this code. (Ord. 1553, 12-16-1996; amd. Ord. 1894, 1-15-2001)
   D.   Restitution By Parent Or Legal Guardian Of Minor Children: The parent or legal guardian of an unemancipated minor defendant who resides with such parent or legal guardian shall be liable for actual damages for the wilful or malicious acts of such a minor which cause injury to a person or property. However, no recovery under this section may exceed one thousand dollars ($1,000.00) for each person injured or for each occurrence of such wilful or malicious acts by the minor causing injury in addition to court costs.
   E.   Court Proceedings In All Court Proceedings Under Subsection D: The Illinois civil practice act shall apply, and all actions shall be brought on behalf of the city and through the attorney for the city, and all damages shall be payable to the person or persons who have suffered actual damages.
